The more I think about it the less sense I can make of this ruling. No body waits until they have to push their car to the pump to get gas, so in theory the intoxicated driver should be able to keep driving which means the seller of the gasoline did not actually contribute to the accident other than a slight increase in the mass of the car. Based on that are we going to hold the highway department liable since they paved the road the intoxicated driver used? What about the manufacturer of the vehicle? Or the last place the driver bought tires from? What about the place that made the driver a copy of the key to the car? What about the shop that repaired the car last, the accident might not have happened had they not fixed the car.
