You are claiming you are falling under the CHL laws by the fact you handed it to them. In this case you might possibility be charged. If you only hand a DL and he comes back and asks about a CHL and you state your license is expired and you are NOT carrying under the CHL laws you have a better chance to fight the charge if you are arrested for carrying.
