The "Please Don't Open Carry" signs
So I noticed this sign on the door of a restaurant I was about to walk into the other day. Correct me if I'm wrong, but these signs are meaningless and it is not a criminal offense to openly carry past one if you have a LTC, since only a written notice compliant with 30.07 is enforceable...right? Ho...

Re: Clarification on proposed open carry law
No, stripping the Huffines amendment does not "allow LEOs to randomly stop and search people . . ." U.S. constitutional law will control. So then why the fierce opposition from LEOs to the amendment? After all, the amendment is just reiterating the current constraints of the Fourth Amendm...

Re: Clarification on proposed open carry law
Looks like the only way OC will get passed now is if the bill is changed to allow LEOs to randomly stop and search people who are OC'ing, solely because they are OC'ing and with no reasonable suspicion the person is committing any crime. I can't believe any state senator or congressman would support...

Re: OC Passed, hmmm. a lot to learn now?
OC passed? Nope. In fact, thanks to the House's vote yesterday not to concur with the Senate version of the bill, OC will now probably die and we get to wait ANOTHER 2 years. Way to go, Legislature! OC was all but a certainty at the beginning of the session, widely supported by the GOP majority, yet...

Re: One problem/issue if licensed OC passes
The act of OC'ing, absent any other circumstances, would not give LEOs reasonable suspicion to detain you and investigate whether you have a CHL. This has been an issue in other states, where someone OC'ing is illegally detained and asked to ID himself to make sure he has a license, and/or is not a...

Re: One problem/issue if licensed OC passes
To stop and detain you and require you to produce a license, the LEO first would need reasonable suspicion to believe you do NOT have a license to OC. They cannot just randomly stop you and demand to see a license, just as LEO cannot randomly stop a vehicle to "check and see" if the driver...

One problem/issue if licensed OC passes
How will LEO know whether a person OC'ing is in fact licensed? The act of OC'ing, absent any other circumstances, would not give LEOs reasonable suspicion to detain you and investigate whether you have a CHL. This has been an issue in other states, where someone OC'ing is illegally detained and aske...

Re: CHL and Class B Misdemeanor
Generally it is best to disclose it all, and provide documentation. If it is a misdemeanor and it's been more than five years, you'll be fine. If they find out you failed to disclose something, that's a bigger problem than whatever it was you were trying to hide.

Re: Bar Patron a hero in Houston, two robbers dead.
This is why the 51% rule is stupid. It's already illegal for a CHL to carry while he or she is intoxicated, so even without the 51% law, it would be illegal for a drunk CHL-holder to be carrying in a bar. What the 51% law does, however, is restrict the ability of sober CHL-holders to protect themsel...

Re: Help with a rule please
Doesn't it say traveling directly to or from your vehicle or home? If that's the case, once you arrive at your vehicle, you need to conceal it per MPA. Right? What am I missing about your question? Mojo - I'm not trying to be rude, but I've explained it twice now. "Traveling" has nothing ...

Re: Help with a rule please
Yes I understand the MPA (Sec. 46.02(a-1)) requires the handgun to be concealed...but the MPA is a part of Sec. 46.02, and Sec. 46.15 says that if I'm "traveling," then Sec. 46.02 as a whole (which includes the MPA) is not applicable. Motorist Protection Act (a) A person commits an offense...

Re: Help with a rule please
Once I enter my vehicle, however, I must then conceal the handgun pursuant to Sec. 46.02(a-1)....UNLESS I am "traveling," in which case I may continue to open carry the handgun because pursuant to Penal Code 46.15(b)(2), if you are "traveling" then Section 46.02 does not apply. ...

Re: Help with a rule please
This is my basic understanding of things. Someone feel free to correct me if you believe I am wrong. I can open carry a handgun inside my home or on my "premises" which includes the real property (e.g., land) surrounding my home that I own. I can continue to open carry that handgun if I am...

Re: Police want to check your serial #
A serial number on a firearm is not in "plain sight." In fact you've got to first seize the weapon and then look closely at it to even read the serial number. While the law allows an LEO to disarm a CHL holder for safety purposes, under the 4th Amendment the LEO still needs PC to "sea...
