I believe that statement to be inaccurate. There needs to be > than 2 years age difference between the parties before it can be statutory rape. Otherwise, why would (legally) a boy of 12 be the one in trouble if his girlfriend is 13? I know laws don't make sense a lot of the time, but that would just be even more stupid than most.
