This is media sensationalism for what I'm told is a standard "affirmative defense" filing. Some real lawyer may want to weigh in.
This accident is clearly a case of the pilot exercising very poor judgment and bad Aeronautical Decision Making.

Technically not true. The helo asked for Special VFR. This is not an exception to flight rules, it is an established procedure. Helos are granted a lot of latitude for flying in marginal conditions because they are helicopters. They can slow down and land wherever. Unfortunately, this pilot chose to press beyond visual and apparently flew into the ground. It is easy to get complacent because after all you are a helo.
