EXACTLY!! WHEN you ARREST an LTC holder....at that point the same principle applies...not before. The problem is, you are wanting to be able to circumvent the legal process and revoke someone BEFORE they've actually committed any offense. You seek to appoint yourself judge and jury and declare someone guilty because, in your opinion, they MIGHT do something at some point in the future. That is just wrong!

Lol not at all. I would let DPS make that determination as we do now. This is my and many other LEOs opinion as we are the ones who deal with gang members and the rest of the scum on a daily basis. Believe what you like, I feel like gang members shouldn't have a LTC and nothing you say is going to change my mind.

Txgang, that's the system my Dept applied to use. It should be part of the application process.

I'll admit that I can't. Some of the biggest dirtbags on the planet tend to wear suits and ties and are much more dangerous to our wallets than a someone who wears less acceptable forms of clothing.

I'm fine with LTC getting taken away if gang membership is proven through a judicial process. I just don't want to shift the burden of proof the other way by abusing the legal process.

What do you do with "gang members" who turn their lives around and have no criminal record? Are they banned for life?
I believe after 5yrs of a clean record they are taken off the gang information system in Texas. I've applied for access to this great system.

After you've worked in a jail for awhile, there're not hard to spot. You learn what to look for in their color of clothing, ink, hand gestures, and what side of the body the hang their rag off of.

The university has a dress code and anything considered "gang related" is strictly prohibited. I just ask for ID or names in an consensual encounter. If they refuse (which rarely happens) and they are not a student, then they are issued a criminal trespass warning and escorted off property as per Dept and university policy.

How would you prove someone is in a street gang if they aren't caught committing crimes? What probable cause do you use to stop and identify someone, if they aren't committing crimes. You would need their identification so you know who's name to submit to the DPS. Do you stop someone who you believe may look like a gang member?
I work for a private university and can usually tell if someone doesn't belong there. It's not hard to spot gang tattoos and clothing style. On private property I can tell someone to leave because I don't like the color of their shoes so yes, I approach these people regularly.

Could be pretty tough to prove.
Issue we have is there is no defenition of a sole "gang member" nor is it a crime to be one.

(a-1) A person commits an offense if the person intentionally, knowingly, or
recklessly carries on or about his or her person a handgun in a motor vehicle or
watercraft that is owned by the person or under the person’s control at any time
in which:
(1) the handgun is in plain view, unless the person is licensed to carry a
handgun under Subchapter H, Chapter 411, Government Code, and the
handgun is carried in a shoulder or belt holster; or
(2) the person is:
(A) engaged in criminal activity, other than a Class C misdemeanor that is
a violation of a law or ordinance regulating traffic or boating;
(B) prohibited by law from possessing a firearm; or
(C) a member of a criminal street gang, as defined by Section 71.01.
I asked about this, the D.A. won't take it if they have a vaild license. IMO if the law, it's doesn't apply to a LTC holder anyway gang member or not.

It could be a slippery slope but I don't like the fact that fellow LTC holders are Cossacks or Aryan Circle. These gangs are getting smart and blessing in guys with a clean record and then using this to their advantage.

We should be able to at least file a case with DPS and present evidence to their gang affiliation and let them make the call of revoking their license.

Gang members with LTC

When I was in a gang training course taught by a local gang detective, he said that our area(also the area of my campus)is starting to see known gang members with valid LTC. The kicker is if they are not involved in any criminal activity there is nothing we can do about it because there isn't any stipulation forbidding gang members from applying for a LTC. Whenever I've had contact with known gangs I try to charge them under TPC 71.02 and add on TPC: 71.028 to enhance it if the D.A. will take it.

Unless there is prior or current criminal activity taking place then our hands are tied as it is not a crime to be a member of a criminal street gang. There needs to be some stipulation that allows LE to be able to revoke their license if we can prove they are a gang member.

MPA has requirement that you cannot carry if you are a gang member. Why was something similar not included in LTC applicants or if they become gang members after receiving their license? We are seeing this mostly with motorcycle gangs and Aryan gangs.
