wouldn't 411.207 pretty much void their policy? i guess since DPS doesn't have any enforcement ability under the CHL provisions, they can't do anything, but surely this would be good fodder for a civil action. n'est pas?

i replied to that guy on GT. i think i'd be consulting with my attorney. with the check that agency would be giving me, i could afford a good one; particularly if it's a written policy.
