Yes, correct. Maybe I was not clear. I drive with it up so you cannot see in to the car from the back. I will lower it so the LEO can see in.mojo84 wrote:It appears you aren't familiar with how the sunscreens work. Lowering it removes it from shading the window. That way, the cop can see in.flechero wrote:My guess is that lowering the screen after you've been lit up will only make him think you are either hiding something or getting a weapon out.... just a lay perspective but I would expect to be met by an "excited" officer on your stop. Around here your #3 might cause an officer to draw his weapon and make #10 begin with "exit the car with your hands up!"RX8er wrote:
That's the way I understand it. Just because I have a CHL does not mean I have to tell an officer I have a firearm in my vehicle or on my persons. I do have to give him my CHL if I am carrying a firearm. If he asks if I am carrying, then I will tell him.
I have rehearsed this in my mind a bunch:
1. I have been lite up
2. slow down and make my way to a safe place to pull over
3. Push the button to lower the rear window sun screen (cops can't see in through this)
4. Turn on the video and audio record of my phone
5. Pull over and turn on my hazards and interior light if needed
6. Turn off the car
7. Pull out my DL, CHL and insurance card
8. Roll down the window
9. Have them in my left hand with both hands on the wheel
10. Wait for instructions from the officer
Nowhere do I tell the officer about any firearms in my possession.
Not something I would do for sure! I like #4 but think #3 is a problem.

That's the way I understand it. Just because I have a CHL does not mean I have to tell an officer I have a firearm in my vehicle or on my persons. I do have to give him my CHL if I am carrying a firearm. If he asks if I am carrying, then I will tell him.3dfxMM wrote: What I was trying to convey earlier (and clearly not succeeding) is that there is no requirement to tell the officer you have a weapon. If he asks, then yes, you should tell him. There are a lot of folks on here and elsewhere who will show their CHL whether carrying or not. I am one of them. However, I am of the opinion that doing that is sufficient. If the officer wants to know more he will ask.

I don't disbelieve you, not flaming you for your story.. but nothing your posting reflects what i am hearing from KPD and other LEO's, or this mornings Desk Sergeant at the KPD station.
When i relate this story, I get the deer in the headlights response, and am told,, MPA is common knowledge, Taught in classes they take as part of becoming a patrol officer, somthing the Training officer will discuss during probation period. And in fact, I have not met an officer yet that does not approach and consider every person they contact to be armed, precisely because of MPA and the large amount of honest citizens that have a CHL.
They all ask me.. WHO is this guy talking to.... they want to know..... I assume, to get the other side of the story, and correct the issue if there is one.
Thanks
Funny, I just called the North Precinct and the guy laughed at me and asked if this a youtube thing or something because I was the third of fourth guy who called.

I am cool with this and actually agree. He did say that I could make a FOIA though for any formal compliments filed.
I'll make a FOIA for yesterday and today for IA in about 30 days. Then from there, I can get an officers name and the videos. I'll keep everyone posted.
Joe Friday keeps coming to mind: All we know are the facts, ma'am.
A question for the OP. Did you make and file a formal complaint? If not, then nothing will happen or come of this.

It does not say this anywhere.locke_n_load wrote:Where does the MPA or 1815 state that the concealed handgun has to be "not easily accessible" from anyone else?
Just thinking of the situation where I'm driving and my handgun is in the glovebox, and my brother is in the passenger seat (closer than I am).
Not that I carry like that, just wondering for others who don't have a CHL but keep one in the truck.
You can have your gun in your seat and place a ball cap or towel over it and be perfectly legal. It just has to be concealed. Some even have holsters that fit in between the center console and seat so they can draw in a matter of milli-seconds.

I think you know but just in case, my comment was directed at the OP.E.Marquez wrote:Exactly, nor is it my desire / intent to turn it against the OP..RX8er wrote:I hope this isn't going to turn in to a LEO bashing thread.

If I had more specifics from the thread, I'd do a FOIA request so we could get the dash cam / mic footage.
I agree completely, we need more info.At this point I just want to understand more of the encounter and those he had contact with..

Re: Do not go into Killeen. You will be sorry.
Welcome to the group and sorry it had to be this story for your first posts. I have always been told and even reinforced by LEO that if you are carrying under MPA, you should only disclose you have a firearm if asked and never volunteer it. There is nothing in the law that says you have to disclose it to an officer if you are not asked. Now, if you have a CHL, it's a little different story.
