Summary...

I went out there today to scope the intersection...The stop sign is turned in such a way that it is hard to determine if the sign is for both directions of thru traffic, or for just one direction...

There is no illumination (light) at this intersection to improve visibility of any traffic control devices...Not that you need it because most traffic indicators have reflective qualities which helps see them, but only if your beams hit them dead on, most of the time...

My argument is this...Obviously she broke the law, got a ticket, and should pay it...But if it was a lie in wait situation, and since she did stop, but only slightly past the plain of where you should stop per the sign...

If all the factors are added up, should we fight this, or seek deferred adjudication and do the defensive driving class and pay whatever fine and fees and move on???

I personally think it was chicken-poop to write the citation in the first place...Since it was a low to zero volume traffic intersection, it was at night, no excessive speed was a factor (she "Wife Unit" drives slower than my grandma going backwards to church on Sunday)...

She just simply missed the proper mark to stop...And now we are on the road to being $215 lighter in "my" wallet...

I'm not at all bitter, I am just exploring options...And open for suggestions from both sides of the aisle...

Steve, in all fairness, you have no idea what actually happened. All you know is what she told you. Is it possible she stopped after she saw him and decided not to continue her roll thru?

That said, if she truly feels she was wronged she should fight it. Its her right under our judicual system.

i can only think of two stop sign offenses; fail to stop at stop sign and fail to stop at proper place. what's the statute that was written?
