This isn't germane to the Heller discussion, but I've always been amazed at this little bit of smoke-and-mirrors municipal legislation in San Antonio.

As you quoted, the muni code reads, "a. It shall be unlawful for any person to intentionally or knowingly carry on or about his person a knife with a blade less than five and one-half (5 1/2) inches in length..."

Fast forward to the Texas State Penal Code, §46.01:
(6) "Illegal knife" means a:

(A) knife with a blade over five and one-half inches...
So SA isn't circumventing the state laws; it just means that the only locking folder you can have in San Antonio (other than the not-applicable provisions) is one that has a blade that is precisely 5.5" long, to the micron. And I'll betcha their police department doesn't have the precision calipers necessary to measure the blade, much less that any two people would measure blade length in exactly the same way.

So the muni code effectively outlaws any locking folder (again, unless you fall into the not-applicable provsions). It just makes me think some city legislator(s) wakes up every day and smirks at how clever he was... :???:

Justice Stevens, in my opinion, that is precisely what the Framers did. In no small part to help assure a government of the people, by the people, and for the people.

Fairfax, VA – Leaders of the National Rifle Association (NRA) praised the Supreme Court’s historic ruling overturning Washington, D.C.’s ban on handguns and on self-defense in the home, in the case of District of Columbia v. Heller.

"This is a great moment in American history. It vindicates individual Americans all over this country who have always known that this is their freedom worth protecting," declared NRA Executive Vice President Wayne LaPierre. "Our founding fathers wrote and intended the Second Amendment to be an individual right. The Supreme Court has now acknowledged it. The Second Amendment as an individual right now becomes a real permanent part of American Constitutional law."

Last year, the District of Columbia appealed a Court of Appeals ruling affirming that the Second Amendment to the Constitution guarantees an individual right to keep and bear arms, and that the District’s bans on handguns, carrying firearms within the home and possession of functional firearms for self-defense violate that fundamental right.

"Anti-gun politicians can no longer deny that the Second Amendment guarantees a fundamental right," said NRA chief lobbyist Chris W. Cox. "All law-abiding Americans have a fundamental, God-given right to defend themselves in their homes. Washington, D.C. must now respect that right."
Initial comments from the Brady Center to Prevent Gun Violence:
The U.S. Supreme Court has just handed down its ruling in District of Columbia v. Heller. The Brady Campaign and Center will post a statement as soon as possible after reviewing the decision.

I think the biggie is Section II. This is the first opinion by SCOTUS that specifically states the 2nd Amendment refers to an individual, not a collective, right. We all assumed we wouldn't get an apple-pie-WITH-ice-cream ruling, but this alone is, I think, a huge achievement for RKBA. It will affect all future, attempted legislation and, trust me, does not make the Brady Bunch happy.

It's in, as of a couple of minutes ago. Justice Scalia wrote the opinion. Justice Breyer dissented, joined by Justices Stevens, Souter and Ginsburg; 5-4, the 2nd Amendment wins.

<grin> Yeppers. I'm afraid my work will suffer a while tomorrow morning while I keep one browser window and both eyes on SCOTUS.

Following the issuance of opinion, almost equally interesting will be the following day or two to see how the media, as well as pro-gun and anti-gun communication engines, treat the ruling.

I'm not quite sleepy just yet... ;-)
