) - if those two conditions haven't been met I don't believe the business has any recourse since there is no contract express or implied (but its been a long time since I studied the Uniform Commercial Code - the UCC). I do believe I would put them on the ignore list unless they actually had my CC number and attempted to make a charge. In that case, I would contest the charge to the CC company.In any case, they sound like a business to avoid at any cost.
