Jallen, is an fbi interview the same as a police interrogation? Are the rules or laws similar?
Also, is it normal for the FBI to make the determination whether to prosecute or not?

FBI agents were subject to special gag order. It makes it obvious a deal was struck on the tarmac.

What Comey seemed to have turned on is that the statute criminalizing gross negligence has never been used in the absence of one of the several circumstances he listed, and it has long been doubted whether the statute is even Constitutional. This may not have been the decision you or I expected, as few of us would have opportunity to be aware of those factors.
What if Comey was sincere, objective, his integrity unsullied by any of the wild accusations leveled at him this week?
Had indictments been recommended, a grand jury would have been impanelled to issue those indictments if it chose to do so. If you think the OJ Simpson case was something, the trial of this case would be an even more enormous spectacle. Imagine the "Dream Team" that would have been assembled! Every word, every e-mail, every computer file and byte would be gone over with the finest tooth comb imaginable.
I cannot imagine how or when, or where it would be possible to select a trial jury which would hear the case with the requisite level of due process to which we are all entitled. She might still beat the rap(s) even so.
When Richard Nixon resigned, some people were after his scalp, not, it developed, without considerable justification. When his successor, Gerald Ford, pardoned him, many were horrified.

It may be that the jury box is not the best way to handle these acts and omissions. The ballot box may be.
I would have more faith in the ballot box if we had a stronger candidate and it wasn't for the electoral college.

The point is, Comey's contention there was no "criminal intent" involved is completely wrong. The whole point of FOIA, the court said, is to provide transparency on public officials' behavior while in office. Circumventing that by hosting government documents on non-governmental servers defeats that purpose, Judge David Sentelle said.

It's obvious you and I disagree. He made a great case FOR prosecution but he decided not to. Clinton's actions and statements are reprehensible but I think FBI Director Comey, also Deputy Attorney General under Bush, is forthright and has little or no incentive to cave in under pressure from the Administration.
The entire testimony was hinged upon "intent". How many people are in jail today even though they didn't intend to break the law? Regardless, the entire reason for her to use a private server was so she could avoid the Freedom of Information laws and accountability. Only naivete and willful blindness could lead anyone to any other conclusion.

I listened to all but about 10% of the hearing today and Comey convinced me. He convinced me 100% Hillary should be prosecuted.
To me, it appears he is has been given marching order and is having to toe the administration line. In other words, it appears an otherwise decent and respected man has caved to the pressure.

Hillary isn't appointing Obama to the Supreme Court.
Even if she wanted to, the Senate would never confirm him, barring a major shake up in the composition of the Senate.
Even if it were to do so, there is no reason to think Obama might be willing to spend the rest of his productive life in the relatively cloistered role of a Supreme Court justice making a few hundred thou per year when he could be out running around fleecing donors for millions, working or not as he saw fit.

Obama would never seek or accept an appointment as a Supreme Court justice. He'd never be willing to step out of the limelight. I look for him to morph his experience as a Community Activist in Chicago (Crime City, USA) and POTUS into his future role of "National Activist": if Hillary wins, we as a nation will continue to have to deal with Obama as a never-fading media presence. Have teleprompter will travel.
But we have no guarantees that the current Senate will not eventually accept a "compromise" and confirm a Hillaryophilic candidate, and if there is a redistribution in the Senate during the administration, well...
As the vote on Obama's immigration action showed, we're on a taut, thin tightrope already. A swing in the ideological composition and personal values at 1 First Street, NE, would have ramifications for not just a Clinton administration, but for a generation...or more. If elected, Hillary can foul up a whole lot of stuff very quickly. But with Justice Scalia's swing vote absent and pending appointment, and with three other of the remaining eight justices over 75 years old--including the "moderate" Kennedy who turns 80 in less than three weeks--it's almost certain the next administration will be nominating (and lobbying for the appointment of) at least two SCOTUS positions, possibly three.
So, yep. I'm afraid. I'm very afraid.

I expect our politicians to get away with high level crime, but I just wish it could be done with a bit more finesse.

I agree, TAM. We can look at Sodom and Gamorrah and see that God will not allow a nation of debauchery and corruption continue without punishment. It is apparent we are heading in a similar direction. There is no way anyone can honestly look at what is going on in our country and call it righteous and just.
As they say, history repeats itself. Human societies have a way of bringing judgement and destruction on themselves. Yesterday's events is just another indicator of how low our country has gone. The progressives have made great strides in our time. I have fought being so pessimistic but I can no longer continue to fight it. My confidence in man is gone and I can only look to God. I guess that is what I should have been doing all along.
I have a good friend that says "if God doesn't deal harshly with the United States of America, he will owe Sodom and Gamorrah an apology. We know God does not allow himself to be put in a position to need to apologize."
