Much more than "mere association" is required for a conviction, otherwise feds could have "RICOed" every patched member and ended all the gangs. You have to be proven to have been involved in directing the "organization". RICO is generally used against the leaders, not the members.

If a MC member doesn't engage in any illegal activity, nor direct such activity, I'm hard pressed to see how denying him a right is constitutional.
Do you plan to file your suit so this can be ajudicated? Do you know of a judicial ruling on this that addresses this issue?

So? How is that relevant to this discussion. I've said in this thread already, not all bad guys are bad all the time and not all good guys are good all the time. I have numerous similar intereactions with tough looking folks that were very positive intereactions. Growing up in Odessa, we used to go hang out at a biker bar on Andrews Hwy and play pool with a bunch of bikers, many OMC members, and they could not have treated us better. That doesn't change the law.

You are conflating the discussion with opinion vs law.

What makes you think I'm going to answer your questions when you ignore mine? Here's some more for you.

Where does it say they have to be actively involved in criminal activity? The law is the law. It is not what you wish it to it was.

Why do you give a newby poster that gives sketchy details the benefit of the doubt over a police officer and his superiors?

You are hitting on something I've been thinking about. It is interesting how people that want to dress and portray themselves as tough bad guys resent it when they are treated as such. All the sudden they become not so tough and cry about being victimized.

Maybe one should reconsider the image one portrays.

Yes, mongoose, whether you want to admit it or not, image matters and we all form opinions based on image.

Sometimes, we are treated according to the company we keep. We make judgments about people all the time. If one invites a negative impression one shouldn't cry about someone having that impression about them.

According to the law, yes. If a person claims and advertises to be part of a gang or OMC and is carrying a firearm, that firearm is not legal as you suggest. That's the law.

I'm not passing judgement on the OP. I am refusing to buy in to his story based on the sketchy details he is sharing while claiming he is a victim of the cops. Seems to me if he wants to claim being a victim of police harrassment or whatever , he should be more forthcoming. He appears to be posting bits and pieces along with a hefty dose innuendo and wants us to sympathize with him.

Read the post in detail again,

Definitely not in a LE club the gentleman made reference to a 3 piece patch and it's meaning I my clubs patch is a 3 piece like LE clubs so to wear a 3 piece patch but they are not classified or profiled as law breaking individuals.
You said "like every other". That implies your club is a law enforcement club.

Does your bottom rocker designate a territory or location?

This comment implies you are in a MC that is made up of current and former law enforcement officers. Is that the case? I think some of us are curious to know if you are actually a victim of unscrupulous cops or are just playing one. Some of the things you've said tend to lead me to the latter.
My patch is a 3 piece patch along with every other law enforcement motorcycle club who wears a 3 piece parch but are not profiled as such
