FBI bulletin to all Texas Law Enforcement Agencies

I just received an email that stated "A bulletin issued to all State Law Enforcement Agencies by the FBI is as follows: STATEWIDE: In light of what happened in Waco, there is enough probable cause to warrant police to pull over any person wearing a Patch and search for weapons, at this point any person wearing a patch of Club insignia is considered a gang member, even if you hold a CHL, you will be arrested."

I am new to this board and this is my first post. I am posting this here because i assume there is folks here knowledgeable enough to know whether there is any truth to this. If there is any truth, it would appear to be a gross misuse of power by law enforcement and a violation of civil rights. I hope someone in the know can assure me this is hog wash.

I dont know who or what NAGR/Dudley Brown is, but thats what my gut instinct is as well. Doesnt sound right. Thanks for the reply.

If i get pulled over and arrested with my CHL, i will be looking for a good attorney, lol.

I just heard the same thing from another source. I ride a Harley, wear a cut, and I'm a member of a riding group (with a patch, but not a bottom rocker-not an official MC).

I carry everywhere it's legal for us CHL holders and this has me a bit worried. Even though I know I'm good based on the law, being arrested and then having to beat the charges has it's own set of ramifications.

I'd really like to hear from the LEOs on the board and what they have actually been instructed to do with regard to this. My thought in the meantime is to just not to wear my cut anymore, but honestly, that has me angry--I shouldn't have to feel that way being a law abiding citizen who has served this country honorably.

If this is true, a legal (non-violent) response is warranted. We should not be treated this way by OUR government.

My take...the FBI is subject to the DOJ. I don't see how the FBI could determine what is or is not probable cause on its own...seems like that would have to be a directive from the DOJ. That then would be a directive for Federal Law Enforcement...don't see how that would then translate to state and local law enforcement making arrests. I also don't see how an incident like the one in Waco changes the definition of probable cause that has been constructed by the courts.

Welcome to the forum. Doesn't sound right for sure. Besides this is Texas and our law enforcement would just laugh it off if it was true. There are many law enforcement folks that ride and belong to clubs. I can just see them pulling over and arresting the Patriot Guard.

As a retired officer, I will second Charles' statement that the FBI would never issue such a bulletin. Not only would it be a false statement about what constitutes probable cause, but it would be a false statement about the consequences of possessing a weapon. Then there is the fact that the FBI does not work on state laws, just federal laws. Unlawfully carrying a weapon would be a state crime and the FBI would know that the laws on this differ in all 50 states.

And finally, there is the fact that the FBI cannot tell state or local police what to do. They may be able to give them requirements for submitting data to the feds, but they cannot even make them submit the data. They can claim jurisdiction in a case if there is a federal law, but can do nothing without that. They can provide assistance if requested by the PD, but it takes certain specific facts to even get that. That does not happen as often as TV makes it seem because it is an open secret that cops and the FBI do not get along professionally.

About the only thing true in the email the OP received would be the premise that the FBI disseminates intelligence information to other police. Almost all frauds and myths like this are based on some small nugget of truth somewhere and that is the only one I see in this.

There were Bandidos gathering at Buccee's in Baytown this morning. Two pulled in right as I was walking in the store. By the time I left, which was quickly, there were more than 25.

Most of those groups just stay out of there way and they will leave you alone. I wouldn't however suggest trying anything funny if they go by you on the road. most people get all freaked out when a motorcyclist gets close to them on the road. All you have to do is drive normally and I assure you if they want to go around they will; and probably be around you faster then you can think about it.

Yeah, I don't think anyone rides alone after Waco. FWIW, when I used to ride and would end up at lake parties Banditos or Cossacks would occasionally show up. Sometimes at the same time. I wouldn't want to get on the wrong side of either but they pretty much kept it cool while they were there.
