Accidentally walked in a place that has a 30.06 sign

Hello folks I'm new to this forum, so please be patient with me. My question is theoretical. What If you missed the 30.06 signs and walked in a place that enforces it. Do you walk straight out as fast as you can, or will alarms go off as soon as you enter? What would be the right thing to do?

The right thing to do would be to turn around and secure your firearm elsewhere. Alarms won't go off, but you should still be vigilant about making sure you don't miss a 30.06.

Welcome to the forum. Ask all the questions you want. One of the most common statements here is "concealed means concealed". No one has the right to search you without cause and you dont have to answer any questions. If you walk into a 30.06 pretend you left something in the car & casually walk out.

There is a story on here about a guy getting to a hospital asap, but once inside, he realizes he's inside a posted 30.06. Once he could effectively do so (his wife arrived), he got the keys & put his weapon in her car. Be cool, don't expose it & resolve it once you realize it. You should be fine.

If you enter a 30.06 posted location and for some valid reason did not see the sign or were otherwise unaware of the posting, then you actually have not been given legal notice. Once you are aware the location is posted 30.06 (see the sign, are told, etc.) then you must leave the location and secure your weapon outside of the 30.06 zone (building, parking lot, etc.)

As other's have said, don't panic, just calmly exit and go secure your weapon. I have actually had that occur where I was unaware a building was posted as the sign was at the main entrance and I didn't see it going in a back entrance. By statute the sign only has to be posted in a conspicuous manner, so not all entrances have to be posted. Once I was aware the location was posted I exited and secured my gun in the vehicle, went back inside and finished my business.

2. As others have said, take it as receiving notice and go secure your firearm. No one has to know but you, especially since the law may not give you points for voluntary compliance.

This is not true. There is no provision in the law stating that you must have seen the sign. If it is posted in compliance with the law then you have been given effective notice.

I know this is a point of contention for many, but I have to agree with Keith on this one. If I enter through the garage entrance of a given location and it is NOT posted, but there is a sign on the front entrance of the building, then yes, the building is posted. But I have not been given notice until I've actually seen the sign. I'd likely get a ride in the back of a cop car, but I'd also probably win in court...especially if there are cameras witnessing me coming in (as there are in so many places these days).

How would you receive notice when you never saw the sign or weren't told. The law says they must 'provide notice' 'to the person' by means of oral or written communication. So, by your interpretation I could just stand out on the property, state orally one time that concealed handguns guns are not allowed, and no matter who heard it would be in violation. Same with the sign. Posting the sign in a conspicuous manner DOES make the property off-limits, but until the 'person receives notice' by seeing the sign, then they have not met the requirements of the statute.

If you walked by the sign and didn't see it, I suppose the court would decide whether it was "conspicuous" and whether all other legal requirements were met. They'll determine whether you "should have seen it."

If you came in through an acceptable entrance that wasn't posted, I would think your chances are good charges would be dropped and or you would be acquitted.

Totally different. All roads in the US have speed limits and when you get your license you know you must follow a posted speed limit. If a road is for some reason NOT posted, then the defacto speed is 30 mph in most cities. Buildings are generally NOT posted with a 30.06 and you do not have to expect they are. If you do not see the sign, then you have NOT been given notice. Period.

I think it would end the arguing if you cited the case law that supercedes the statutory definition of notice in 30.06 so people could see for themselves.
