The blue sheet with your application says to send in court papers IF you have them. They do not reguire them but like to have them if you have them. This was confirmed by email from CHL rep III. They have all your arrest and disposition on computer if they were anytime in recent history. Look and the blue sheet again that came with your application. I realize the yellow app says to send the court papers in bold.....

Who is "they" who have your arrest record on computer? I went ahead and got the court papers. If it were a year earlier it would have been gone since they cut it off in 1989. They is the DPS CHL department. My CHL was revoked 8 years ago for a class B and when I called and emailed them they looked up the conviction and told me the dispossition and if I had the court papers fine but not required.

They told me it would be ten business days, but Tarrant county had them to me within a week. It was a lot quicker than I thought and my app is finally mailed in. I meant I already sent my application to Austin. I will supplement it with the court papers next week when they come in. Does any one know if this would happen to exponged records. I have a similiar problem, although when I talked to my attorney he said exponged meant any record of it is deleted from every where it went. I have a fear it will come up.
Never went to court as the case was dismissed and charges dropped, record exponged.

I asked my CHL instructor about that and he said just to write "expunged" next to it. I would definitely list the arrest. It asks for arrests of any kind. If you want to get the court papers then call the court where it happened and see if they even have a record. Worst case scenario is that they send back your paperwork and ask you to get court documents, but at least you were honest about your arrest record.

Was the expunction in Texas? Are you SURE it was expunged. Expunction requests are filed with the court and go through the DA/CA office, and are not cheap. It was good advice to tell you to check the court clerks in the county where the incident occurred.

Expungement
Hello, I also had an expungement done in California and it still popped up on the Texas background check. I had to send certified copy of expungement/dismissal. I don't know how much time it added and my application is still processing application. I called the CHL/DPS lady and she said the lawyers had it and that it should be a couple of weeks. June 18th is when I spoke with her. I did not put down this conviction being that it was expunged. My advice put it down with a certified copy of the expungement/dismissal paperwork.

Thanks for the replies. It would seem meaningless to expunge a record then have to divulge the information later. The entire process is meant to protect a person from being falsely arrested or charge for a crime. My attorney at the time advised me that I would never have to admit to anything unless in court, under oath.
I try to follow the system but sometimes the system just fails you and perhaps your only recourse is to no longer follow it.

I hear you, but it asks for "arrests." Even going back to juvenile. Why does it ask that? I have no idea.
