Sounds like the Chief there needs to attend a class or get in the books and educate himself...he might end up costing that town some money when one of his officers arrests someone who has enough money to pursue a lawsuit. Hopefully, though, his officers are better informed of the law than he is...terrible that he would spread such improper information, though.

Several years ago, an incident occured and the wife did not know whether there was a weapon in the vehicle or not. She kept lling herself the vehicle could be used as a weapon. Two things came out of that day, she carries all of the time now and it is known a weapon is in the car besides. No surprises..except maybe, to a bad guy.

I believe part of that misinformation (self included) has come through careless wording of not only instructors but of the DPS training. We were told in instructor school "I'll know you have a CHL when I run your LICENSE anyway." Well, is that DL or license PLATES? In my mind, and many others, we assumed PLATES. TX Lobo correctly explained to me the process...

Bottom line was he KNEW but said didn't want to encourage people to have a gun in their car w/o a CHL. I have been told by several that Houston has had some issues with MPA not being honored and creating problems.

CHL status is not linked to your vehicle registration nor to your Texas DL. The end. :mrgreen:

CHL files are a separate file that is entered and stored into TCIC. Whenever a LEO does a DL/Warrant combo check, the TCIC hit will return. Because of this if he, (or his dispatcher), only runs your DL to check your DL status, they will not get the TCIC check back. This usually isn't an issue however, as most agencies routinely run a complete check by name/dob, and not just a DL check.

There were some issues with a Harris County DA, Chuck Rosenthal who refused to acknowledge the traveling law with its exemption & defense for prosecution that was written in to protect motorist. The MPA was was rewritten to make the proctection that was written into the traveling laws more bullet proof for motorist. Chuckey was forced to resign under disgrace for his disregard of the laws that he was charged with enforcing. I haven't heard of any issues of the blatent disregard of our right to protect our selves since Chucky left.

Any Police officer, DA or Chief who uses his office to forward his own political agenda when it conflicts with the law needs to be made to go away.

A locked car is secure storage. Tell the person about the gun and to lock the doors. If the person isn't responsible enough to secure the doors they may not need to be driving a vehicle. Isn’t there a state law that we have to lock our vehicle doors? That doesn't insure the car won't be broken into and the gun stolen but that can be said of a house or even a safe. Best if it is on the CHL holder but not everybody is a CHL holder. Constitutional or diplomatic carry might solve the problem of guns left in cars.

Not that I know and hard to do when you drive a jeep without doors. I also know people with rag top sports cars that leave the doors unlocked in the hope a thief will simply try the door before using a pocket knife to cut through the fabric and cause hundreds of dollars of damage to steal the pack of cigarettes in the cup holder.

I was diappointed to hear this morning that a Kendall County deputy sheriff told a friend of mine something similar last week. The deputy told my buddy if a gun is carried in the car by someone that does not have their CHL "the gun could not have a round in the chamber, couldn't be within arms reach of the driver and could not be visible from outside the vehicle. My response was, "well, he got one of the three correct". Unfortunately, my buddy took what the deputy told him as gospel because he is a LEO and should know the law. I advised him to read the law for himself and also check out this forum.

Just last night
KWTX channel 10 Waco/Temple/Killeen etc TV news had a video about the "New Law" allowing anyone anywhere in Texas to carry a loaded gun in their car, and had a Sheriff on explaining that it had to be concealed and not while committing a crime etc.

I was like ... "new"?

However, I see no video online

EDIT TO ADD: the License Plate does not show a CHL, only the drivers license check. The only way they may know ahead of time is of they do a second run of the individual's name that came back to the plate and it would show he has a CHL.
For further clarification there are two types of checks one can do with a MDC/TLETS Terminal and they are a DL Check and a Wanted Person Query.... A CHL Return will only come back on a Wanted Person Query as a TCIC Hit....

As for a secondary search on your name after a registration is run would be impossible unless they had some other identifying information (i.e. SSN, DOB). If you do not know the DL# then you have to have dob or ssn to even look up the DL Information, which you would need in order to know there DOB before you can do a wanted person query (QW for you TLETS certified people out there)

There is a reason they are called law ENFORCEMENT officers. They are supposed to ENFORCE the laws that are "on the books", not make up laws of their own like mini-legislators...I don't know who that chief that was talked about above might be, but I'd sure like to know so I don't ever make the accident of bringing any of my money to his town. :mad5

well officers are suposed to know the law and ive seen a lot of them who couldnt hit the broad side of a barn at 10 feet with their guns. so who knows.
