And you would never get a jury to see it that way. You would certainly not get the anti-gun SIL to see it that way. She was merely saving him from his evil self, since he MUST want to shoot someone if he has a gun. Guns are skeery. TIC.

I guess I see it different. I figure I'm responsible for the status of my weapon. If you put it in your holster without checking it, then it's your fault if its unloaded.WheySmart wrote:That sister-in-law could have killed him, she is guilty of attempted murder and his wife is guilty of aiding a felon...in my mind anyway. I am serious, if he had needed that and it had been unloaded he could have very well been killed...it is just like taking the brakes out of someones car. Because of her trying to impose her anti-gun beliefs in his home she risked his life, thats not right.

So if someone removes your brakes during the night and you fling off into the water and drown it is your fault for not doing a brake check? It is the same principal, she sabotaged a piece of equipment that was key to his safety, had anything happened to him I certainly would have pressed charges even if it were to just make her pay money into court fees....what she did was unjustified, she was not in danger, she put a good guy in danger.TX Rancher wrote:I guess I see it different. I don’t see the brake discussion as relevant. But to answer your question, yes, I would have caught it before I got off my property, and yes the person that cut my brake line is guilty of committing a crime. I know of no laws, civil or criminal, that forbid a person from unloading a weapon in their house, or requires them to inform anyone they’ve done so. But I could be wrong, and there are folks on this forum who are very well versed in law, and I will bow to their insights on the subject.WheySmart wrote:TX Rancher wrote:WheySmart wrote:That sister-in-law could have killed him, she is guilty of attempted murder and his wife is guilty of aiding a felon...in my mind anyway. Should she have unloaded his weapon…that’s between them. But checking the status of a weapon every time it’s been out of your control is prudent and would have alleviated the problem. You’ll notice the agent now checks his weapon every time.
The goal is to avoid getting dead, and it starts with taking responsibility for yourself. It wouldn’t mater to him if he got in a gun fight that day who unloaded his gun, he could still be dead…and to me dead right is a dubious honor and one to be avoided.
By the way, I had this lesson driven home to me once. I hadn’t chambered a round and when the time came to transition to pistol, nothing happened. Tap, rack, pull the trigger and it went boom, but the point was driven home to me very forcefully. Check your weapon before you holster it, the life you save may be your own.
The status of the weapon I’m depending on is my responsibility. That’s my stance and I’m sticking to it. You’ll draw the line where you want to draw it, and I respect that, so you’ll notice I never said you were wrong.

I totally agree with both sides of this story.......
YES your weapon SHOULD be checked everytime...YOUR gun is YOUR responsability.....
NO she SHOULDNT have unloaded it....or at the very least asked him to unload it or told him RIGHT THEN that she had.

Your Respesponsibility
TX Rancher,
I agree with you, it is your responsibility for the performance and use of the tool, thus it is also your responsibility of the tool when not in your possession. The wife and sister-in-law should not have tampered with the tools of his trade without his supervision and knowledge.
He should have a conversation with both and explain how serious the situation is and could have become. Also explain that if the sister-in-law is anti-gun or afraid of guns, then don't come on his property. This is the same attitude that anti's have with pro-guns.

Thank You TX Rancher,
I learned all of my Gun and Knife safety from my Grandad. He was a Royal Ranger Leader for 40+ years, maybe more. I took all he taught me to Heart. I am Very picky about Gun and Knife safety. To the point that I wont let my MOM hand me a knife the wrong way. He is Her Dad so she respects it totally. Till now, Fortunatly, I havnt had any N/Ds or other mishaps. I PRAY I keep my record clean.

If I was in that situation it would possibly be grounds for divorce. But then again I ALWAYS check my gun.
