You are correct but we were taught that we are responsible for bullet we fire. Mr. Houston made some poor decisions:
* He was CHL, Awful House is probably not 30.06, but gun was in the car.
* He knew the site had been robbed 4 times recently, yet went in there with $600 cash.
Although many comments above have been made, speculating on where his rounds went,
maybe they all went into the Tahoe, since HPD didn't charge him with anything.
Texas law allows us to try and recover our property immediately after the robbery, hence
the "Fresh Pursuit" angle.
In the end, Mr. Houston was not successful in hitting any of the BG's as far as we know, but
I kind of like the fact that he was not going to let their robbing go unanswered.
From where I sit, I'm not in any kind of trouble, and I'm glad he tried to put some lead into
these lowlifes, even though his tactics didn't produce the desired effect (9MM JHP's in each
BG).
The law professor may have made a slight mistake when he said that the robbers had "automatic"
weapons. I couldn't ID the long gun that one of the BG's had, but the other 2 probably had semi-auto
handguns.

By the time he was interviewed, he knew it had been robbed four times before. He might have learned that information from the police during the investigation. There is nothing to say for sure that he knew this information before choosing to eat there.

After watching a more full surveillance video of the robbery, I still can't fault the CHLers actions.
As the robbers exited, the CHLer was up and out the door within 2 seconds following them.
I don't think he followed out of "revenge", I think he gave chase out of natural instinct.
Did he do everything right? No. Was it the decision many here would have made? No.
A few of the factors in his decision making we seem to be passing over. As soon as the robbers
entered the WH the CHLer had a gun stuffed into his face. Looking down the barrel of a
gun would give me an adrenaline dump. There's no telling the buzz of total focus it gave the
CHLer. Thus his response of retrieving his firearm.
I think it would be interesting to know how many rounds actually hit the Tahoe. Poking around
on the i-net I have found nothing to indicate any of the expended rounds, fired while running,
damaged any property or person. They could just as easily been fired into the asphalt/ground.

The first thing he did wrong was not having his handgun on him instead of in the car. If the waffle house had a 30.06 sign then he should have picked a different waffle house. That being said it wouldn't be a good idea to draw your weapon on 3 armed men especially when there are bystanders around. But had he had his handgun on him he could have waited patiently for an opportunity to stop them either as they were exiting the building or distracted in some other way. He said he fired 5 shots while running. I think this was his biggest mistake. Your shots should have a purpose. If you want to "Fire for effect" join the military. He's lucky nobody got hurt.
Everybody should constantly play the 'what if' game. Work out what you would do in those "what if" situations and maybe you'll be able to act accordingly.

I was under the impression it was similar to suppression fire.
