Liquor Store Sign... (???)

#1

Post by ScottDLS »

So I am in the Houston area today and went to a liquor store west of the beltway off I-10. They had no less than three signs...

-1 Unlicensed possession "blue" sign.
-2 Felony Unlicensed AND Licensed posession sign, with NO 51% in red.
-3 It is a Misdemeanor to consume liquor on these premises.

And then one about obtaining forced labor by immigrants or something... Thought US dealt with that one in 1860-1865...

#1 & #3 are valid. But I've seen #2 on several liquor stores in the Hill Country and now in Houston. Best I can tell this is the sign that Hospitals are required to post, even though it carries no force of law for CHL today.

I wasn't going to bring it up with the proprietors as my Hindi/Urdu and Spanish are limted...and in my limited experience in said store, these seemed to be the predominant languages spoken. And NO I didn't sample any of my purchases while carrying under CHL.

Anybody else seen the Hospital sign on your local spirits retailer/whiskey merchant?

Despite the sign color designated on the liquor license, there's no requirement that the unlicensed possession signs be in any particular color. Both blue and red would be valid. The only color requirement is on the 51% signs, where the 51% must be in red.

True...by the "blue" sign I meant the Unlicensed Possession which is required to be posted though not relevant to CHL'ers. And actually as all the signs, it was in black and white, though they all seemed to have a Texas seal on them.

I was in a liquor store this morning and was aloud to taste three different ages of Laphroaig (very expensive single malt scotch) and a Jack Daniels Single Barrel (each chain or liquor store has their own barrel). How do the laws work on consuming beverages in liquor stores when talking about "tasting". It is not uncommon for liquor stores to allow tasting of everything from wine to liquor. I wonder how that affects the whole 51% rule?

red is on premise consumption if sales exceed 50%

check the license, sign=Blue, TABC can have the incorrect 51% sign removed if it bothers you.

I had not thought much about it until I read this thread. Thanks... after the free booze, we would have all gone into the parking lot and fired a few rounds into the air but nobody was sober enough to find the door.

"rlol" Like going to Baskin Robbins every day, and sampling 31 flavors every day, but still not "purchasing anything for on premise consumption"

the statement I made was in reference to the fact that liquor stores do not usually have a 51%(not 50 as you said it can be 50.4 and not qualify) if the liquor store is allowing people to taste test and they are not selling shots its not a violation of the law. I didn't say anything about anyone having an improper 51% sign

Scott did, in the original post about hill country and Houston stores posting 3 signs
Forgive me lol, it's almost 3:00 A.M., brain not awake, guess I'm mentally merging posts together ... checking the forum before hiding the wireless keyboard and mouse (my niece arrives at 3:30 so I can take her to school; she's grounded from computers/phones etc)

That kind of unruly devil's play, among other myths, is what's preventing us from having liquor stores within a day's ride over here in the Pineys. :banghead:
