Legality of Double-Taps in TX

Okay, I'm reading a Guns and Ammo mag and going through the reader's letters section....some guy writes in from Dallas. In the article, he says he recently took a CHL course and had an interesting comment.

During the class, he was told that if they were to be in a defensive situation and fired upon the bad guy, that they had to wait after the first shot to see if the BG was no longer a threat before he could fire the second shot. The traditional "double-tap" would invite prosecution. And, he stated this was a recent change in TX law.

Anybody hear anything about this? I've always been of the belief that prosecution will be quick and as severe as possible should one have to defend themselves with a firearm. But, this scenario even surprises me.

If I were to the point that I was shooting someone, I am not going to wait to see if they shoot back before I fire the second shot. If the situation has already warranted me shooting someone, I'm going to fire until there is no longer a threat.

I was told the same thing when I took my CHL course in Dallas in July. maybe we had the same instructor. I disregarded what he said as I was taught in a another defensive shooting class to keep shooting until the other person was no longer a threat. That means until he is down or runs away.

I practice the Double Tap at every range visit. I only hope I can do it under pressure and fight the temptation to run it dry. Don't forget, you are being attacked and you are NOT the aggressor. That should be a resonable defense.

My standard advice applies: when the entrance wound, exit wound, and hole in the floor all line up at a nearly vertical trajectory, then that's one shot too many.

Another good reason to use hollowpoints, eh?

This summer in Lubbock, a young man forced his way into an apartment and attacked another young man, thinking that he was the "ex" of the attacker's girlfriend. Roommate awoke and emptied a magazine into the attacker. He then retrieved a fresh mag from his room and did it all over again. No charges were filed. I suppose it was too hard to line up all those holes.

You should practice more than just double taps also. I see people all of the time going "bang-bang" then pausing, looking at the target etc. You need to practice a variety of strings.

Advise I was given by a cop was "Shoot to slidelock, reload, repeat if necessary."

Any handgun is a pathetically poor stopper so, shooting one or two times and assessing the situation just isn't the thing to do.

I was told to double tap. Repat if neccesary. Shouldn't empty the mag unless they're still comming at you and if there's more attackers.
