This is my company policy regarding weapons that are in my handbook. Would I be in violation if I kept in the parking lot. It appears that it only states the building.

**** has a strict policy of not allowing weapons in our buildings. The possession of a weapon
in a ***** facility, even if you have a permit for the weapon, will result in termination of your
employment.

No, oral notice only has to be someone of authority telling you 'No guns allowed here' and that is it. If in the manual, then it has to be 30.06 wording.

30.06 has nothing to do with alcohol. 30.06 is to prevent CHL holder from entering a location period. 51% signs are the ones showing an establishment that makes 51% or more of their revenue from serving alcohol for on premise consumption is off limits.

Private businesses can restrict parking lot with 30.06. So can hospitals. Some schools have posted 30.06 in parking lots, but not really valid as they are government, but there are other restrictions on schools that are in the statutes that must be adhered to.

From what I read, no, it seems your employer only cares about the building/facility, not the parking lot or other areas of company property. :tiphat:

Here's an area of splitting hairs (maybe?)...in Texas, it's not a *permit* but it's a *license*.

What's the legal difference, any lawyers here (or someone who stayed in a Holiday Inn Express last night? LOL)?

I looked up "permit" and according to Merriam-Webster Dictionary:
1 : a written warrant or license granted by one having authority <a gun permit>

So, not sure if that would help.

I believe that the only loophole you might have is if your employer shares a parking lot with other businesses. If so, then I don't think you can be barred from storing your weapon in your car. But that is a small loophole. If you company owns the lot, then you're out of luck.

Remember, not all schools are public. Private schools and universities currently can prohibit weapons anywhere on campus - including the parking lot.

My company owns the log, but it does not say anywhere in the handbook about the parking lot. Just the buildings. I am pretty sure I am safe, but you know Texas is a fire-at will state.

In Texas, you can be fired for:

* having a gun,
* not having a gun, and;
* anything else.

There's a pretty good chance that no one will see you monkeying around in your trunk a couple of times each day and report suspicious behavior to someone who tells someone else who calls the police and reports that there is a guy with a GUN in the parking lot.

You can always get another job; however, you can only be shot a few times.

My company runs dogs in the parking lot regularly. I hope the bill over-riding the company policies passes this session. Heck, they almost fired someone with empty beer cans in the bed of his truck last sweep. They fire anyone for the slightest reason since the job market is so bad. With all the powder residue in my truck from the range trips and hauling empty cases from the club, I figured all the deployed dogs would be circled around it barking! lol

I keep it "clean" since I need to keep my job, but we sure feel persecuted here at the plant.

I agree that as an employee, I can be fired for *anything* (barring EEOC or protected class issues) in Texas. My question is, can I be prosecuted for it under criminal trespass? My HR policy reads
Failure to abide by all terms and conditions of the policies described above may result in
discipline up to and including termination. Further, carrying a weapon onto Company
property in violation of this policy will be considered an act of criminal trespass and will be
grounds for immediate removal from the Company property, and may result in
prosecution.
And evidently I should be careful about checking and responding to my email from my phone when I'm at the range during lunch.
All Company employees are also prohibited from carrying a weapon while in the course
and scope of performing their job for the Company, whether they are on Company
property at the time or not and whether they are licensed to carry a handgun or not.
Employees may not carry a weapon covered by this policy while performing any task on
the Company’s behalf.
Sigh. Anyone need a Microsoft Certified MCITP:EA System Administrator at a business that requires carrying a handgun?

Based on the way it is written here, no they cannot prosecute UNLESS they have given verbal notice as well. NOTE: if in court, all they would have to say is "I told him when we hired him no weapons were allowed" and you would be toast.

Thanks a bunch for the correction - I study my laws carefully, but for some reason equated 30.06 with the 51%.
Learned something today and do appreciate it.

Well in the Texas Medical Center most of the garages and such are owned and run by TMC and not by anyone else. The hospitals and such really have no control over anything there. I work for a medical school and we cant have guns but the parking garage right next to the building is owned by tmc and they cant do squat about that.
