I think that Jim did the right thing. No shots were fired and nobody was injured. Returning to the scene, armed, to confront the neighbor could be viewed as escalation. Calling LCPD was the proper thing to do. If it happens again, they now have a police report. As far as pressing charges, that is the prerogative of Jim and his wife. Since all of the witnesses, except Jim's wife, were probably related to the perpetrator it would be hard to prove any charges.

Thanks, folks. You know I just knew it would come up about not carrying in your own "safe" neighborhood. You are all correct, my guard was down and it might have gotten ugly (actually, more ugly).

I guess not pressing charges might have been the wrong answer, but calling in the gendarme certainly worked out. I do sort of feel like a "facilitator" for his bad behavior.

I think what I wanted to share most was how ugly it can get when you abuse your CHL and how as a responsible person de-escalating is the right answer and certainly getting the police involved rather than going vigilante is the right thing to do. Now there is a record of the event and should anything ugly happen, the stage will be set.

Having a CHL is a big responsibility and we are under a microscope and must constanty give the right image.

On a more positive note, (sort of -- if calling the police because your wife's son's truck [yup, the policeman] was broken in to can be positive) the Constable who showed up at the Northern Tools place in north 45 was very appreciative of the fact that I told him I was carrying and had a CHL. He said that it was okay with him and did not want to see the gun or disarm me. BTW, this place gets cars broken in to ALL the time, bad place to go at all.

Klinejg, I think you handled it just right (with the obvious exception of not carrying). Before calling the police you went and tried to talk to the neighbor about the problem. As an officer, i always thought mor epeople should try talking with their neighbors first, and then call us when it did not work, instead of just calling us with anonymous reports about a problem.

And, when the talk was not productive, you left and called the police. The threats from him were good reason to leave the area and let the professionals handle it.

As for filing charges, I am not sure you really could have made a case worth the hassle of filing charges. The threats to you are very marginal for a threat charge. The win at your wife's car was a good case for criminal mischief (class C, for inconvenience, more if there was actual damage). It might have been an assault, but it would also be a class C since there was no real contact with your wife and no injuries. Class C misdemeanors very rarely do the person filing the charge any real good, though they do get the criminal a record with the police. If the police thought the guy needed a trip to jail, they coul dhave done it already for public intoxication, so they must have agreed with you that it was not needed quite yet.

But, I do want to warn you now to be careful of further action. If the neighbor does anything more to you, it will probably meet the grounds of retaliation. Any illegal act done to you because you called the police is retaliation, and that is a felony. I do strongly recommend that you file that charge if it becomes necessary.

He informed me that he had a CHL and was going to get his gun -- twice!

I had a neighbour like this many years ago. He once literally threatened me with firearm violence right in front of my then 3 year old son. I moved away from that house as quickly as I was able to. It's unfortunate that I had to move away, but the safety of my family was by far the most important thing on my mind at that time.

With such boorish behavior from an adult (ha ha) father, I would think that poor

I travel through suburban neighborhoods all the time where parents let their kids
play in the street. Then when someone drives down the street at a legal speed, the parents
give the driver the stink eye.

Another thing that bugs me is when parents put out those little neon green plastic men with the
orange flags, in the street in front of their house. They say something about "Drive slow - kids".
Well I say the parents ought to be watching their precious ones so they don't play in the street.

Don't rely on some yuppie little toy man to protect them.

Yeah, what's up with that! We ought to be giving them the stink eye! How about taking your kids to a park? Those "slow down" signs make me crazy too!

I agree...What is the street name and general block number, so we can avoid that area...Some of us do live fairly close to that area...It would be good to know...I could care less about the wine sipper myself, I don't particularly care to run near them...
