Showing Identification

#1

Post by Bob Landry »

Do you or do you not legally have to show a LEO your CHL if asked for ID and you are not carrying. I know the prudent thing to do, but what does the law say. I've read a couple of threads on here that say you don't have to an I've had one Deputy tell me that, but I've looked through the 2007-2008 handbook and I can't find anything that indicates that requirement has been changed. So, what say the law?

The legal requirement to display your CHL applies only if you are armed.

Chas.
Tex. Gov't Code §411.205 wrote:Sec.A411.205. DISPLAYING LICENSE; PENALTY. (a)If a
license holder is carrying a handgun
on or about the license
holder ’s person when a magistrate or a peace officer demands that
the license holder display identification, the license holder shall
display both the license holder ’s driver ’s license or
identification certificate issued by the department and the license
holder ’s handgun license. A person who fails or refuses to display
the license and identification as required by this subsection is
202 subject to suspension of the person ’s license as provided by
Section 411.187.
(b)A person commits an offense if the person fails or
refuses to display the license and identification as required by
Subsection (a) after previously having had the person ’s license
suspended for a violation of that subsection. An offense under this
subsection is a Class B misdemeanor.

The idoicracy of this is that an UNLICENSED person who is carrying on or about their person while in their vehicle travelling does not need to notify a LEO that they are carrying...... Why should a CHL holder be required to identify themselves, its not as thought LEO's don't have the info in a database anyway.

This is why we must support Rep Carl Isett's HB 410
