Yesterday on the radio I heard a radio guy on a show called Gun Talk.

He stated that there is no law that guns be registered, Can someone elaborate on this. I thought that is what they were doing at the same time as the BG check?

For example, the state where the POTUS hails from requires firearm registration.

Technically the firearms are not registered (they are de facto registered) but the FOID (Fire Arms Owners ID) registers the law compliant owners. The FOID is similar to getting a CHL in TX and is needed for any resident to possess ammunition or a firearm in IL.

I moved from IL years ago because firearms ownership is onerous, restrictive and the laws are the "gotcha" type of laws that entrap legal gun owners.

If the person buying in Texas does not have a CHL, then the FFL completes the form and calls it in, including the serial number of the gun being purchased. This of course puts the "De Facto Registration" in someones database (NCIS/BATF.....whoever).

But, if a Texas CHL holder buys a gun, the form is filled out and the FFL completes it with the serial number and no calls are made and the Form never goes anywhere. Only to remain with the transferring FFL until it is destroyed (after 12 or 24 Months)? Therefore, the De Facto Registration never happens with Texas CHL Holders.

Can you reference the law that allows a FFL to destroy records after 12 or 24 months?

27 CFR 178.129 requires a FFL to retain the 4473 for 20 years unless someone flunks the NICS check and can't get the gun. Then a FFL only has to keep the 4473 for 5 years. When a FFL goes out of business they have to give their records to the government. There's no exemption for Texas CHL holders. That sounds like registration to me.

Unless the BATFE makes a quick visit beforehand and enters all forms into an electronic database... or they'll deny the FFL a renewel before the 20 yrs and require him/her to submit all 4473's.

And when I moved from NY to IL, a corporate relocation, I finally was able to own handguns. Of course in order to actually own my long guns, I had to have a FOID, but my long guns were never "registered" in IL because they were not purchased there. As a matter of fact, several of my long guns were never on 4473s.

The anti-rights idiots are right about one thing, the current patchwork of gun laws is a sad state of affairs and there is much confusion about what is illegal where and with which and to whom, and it all could be straightened out by just adopting nationwide Vermont style carry.
