I am taking some time off to go take a CBP test next month. I currently do not have my CHL, my question is should I take my gun with me or leave it. I am not planning on carrying while I am there, but I would feel better knowing it is safe with me, and that I have it just in case. My apt. has been broke into once already. Because of this I do not feel safe leaving it home for a week while I am gone. Is it legal for me to transport it to San Antonio with me while I am taking the Border Patrol test? Thanks for all the help guys. Also if any LEO could answer that would be great. A buddy of mine that works for DART along with another said I should be fine as long as it is put up not loaded.

There's big arguments on this board about this subject.

Basically, under texas law, if you're "Travelling" you can have your gun, loaded, with you. Some police and DA's play fast and loose with the travelling law, and might want to arrest you anyway. I wouldn't recommend it.

It'd be perfectly legal for you to keep it with you, unloaded, locked in a container, locked in a trunk.

I think I might just take it, but keep it locked up. I don't need it on my hip while driving. We are going straight there and it doesn't take several days to get there. I just dont want to leave it

"technically" you can have it loaded as long as it is concealed and the meet the 5 presumptions for travelling layed out in HB 813....

THAT SAID - the only safe way is the old fashioned way of unloaded and locked/unnaccessable (ie toolbox, trunk, bed).

Have a safe trip and do well on your test.

Well that was what I was planning on doing. I was never planning on having it loaded beside me. So I am safe no matter what as long as it is tucked in bed safely? Thanks guys
