school property

#1

Post by rushman »

Several days a week, outside school hours, my kids and I will walk to the playground at the elementary school close to our house. Due to dogs and possible thugs, I carry.

One day, there was an after school event with about 50 kids so I turned around and took my gun back home. Other than those situations, is it legal to carry on the school proprerty?

Oh, there are also kids there with soccer and softball teams for practice from time to time. These aren't school functions so that's no problem, right?

As long as you are not in a building and there is no school function going on, you're okay. From your descriptions, you've been doing things exactly right. Private (non-school) groups having sports practices do not bar CHL'ers; other kids and parents anjoying the (outdoor) facilities of the school do not bar CHL'ers; an after school event that was for the school does bar CHL'ers.

Keep carrying safely!

I think you have done right except for that one time you took it back home. Keep carrying unless the event is school sponsored.

Most of the Plano schools in the area that I am in are posted 30.06 at the entrance to the parking lots. That being the case, is it legal to be on the grounds at any time? Or are the signs not valid?

TPC §30.06 signs are not effective on government property, unless the locations are already statutorily off-limits to armed CHLs pursuant to TPC §§ 46.03 or 46.035. Parking lot are not off-limits, so 30.06 signs on public school parking lots are not effective, per the express language in TPC §30.06.

Perhaps the Plano I.S.D. was confused by the TSTA newsletter that claimed HB2112 prohibits any firearms on school campuses! "rlol" :smilelol5: "rlol"

Chas.
TPC §30.06(e) wrote: (e) It is an exception to the application of this section
that the property on which the license holder carries a handgun is
owned or leased by a governmental entity and is not a premises or
other place on which the license holder is prohibited from carrying
the handgun under Section 46.03 or 46.035.

This response assumes that you are speaking of public schools. You didn't specify public or private - just Plano. If they are public schools, then they are a government agency and the 30.06 signs have no effect. If they are a private school, then they can post legally enforceable 30.06 signs and you would be barred from the parking lot as well.

I was under the impression that this was a scholl sponsored activity, which would make carrying illegal. However, as others have pointed out, if it was an after school activity for an other organization (let's say Boy Scouts for example), then carrying would still be legal for CHL'ers. I apologize if I jumped to a wrong conclusion about the after school event in my earlier post.

I aplogize for not being more specific. This was in fact a school sponsored event at the school's playground, after regular school hours. That's why I took the handgun home then returned.
