Then it goes downhill for the prosecution from there. Looks like the witness may have just scuttled his civil lawsuit too during the defense cross-examination.
This definitely backfired for the prosecution. The photo of Gaige pulling his gun from his waistband“30+ ft” behind Kyle proves he was armed and “chasing” him, then the photo that clearly shows Gaige pointing a gun at Kyle, by his own adminission, within 3 ft of him, before Kyle fired. Ouch. The defense is well prepared for this cross.

While the court is in recess for lunch let me just say that after the cross examination the Jury can't help but question every aspect of the prosecution since they were depending on this witness. The body language of the prosecution, especially stay-puff's multiple face palms, only cements my belief that the defense has already won most of this case as long as the jury isn't blatantly biased.

Facebook seems to be filled today with how bad it is going for the prosecutor today.

But I must be missing the real truth here.

Witness said he was trying to surrender to Kyle when Kyle shot him. I mean that sounds so sincere. If I was on the jury I would totally believe this victim.

I wouldn't. His actions were how a would-be predator would act - rapidly storming up towards a seated individual, halting in apparent surrender and then dropping the (armed) hand to point the pistol towards that individual.

Walks like a duck, talks like a duck, acts like a duck....

As for the prosecutor, to my mind it's possible that he's subtly sabotaging his own case.

:lol::

That would be hilarious if the situation weren't serious.

On this list of 160 hunting rifle calibers, 223 Remington is number 13 out of 160... one of the smallest rifle "calibers" available... by bullet diameter .172, .204, and .223 (22 Rimfire) are the only ones smaller

Gaige has clearly never seen a shotgun before in his life and is not qualified to speak about firearms.

Now that Grosskreutz just confessed on the stand to assault with a firearm will he finally get charged?

{Grosskreutz} did reveal that he was carrying a gun despite having an expired concealed carry permit....he defense said it’s illegal in Wisconsin to carry a gun concealed without a valid permit, but that he was never charged with a crime. Grosskreutz did not dispute that.
He does, however, have a prior misdemeanor conviction for intoxicated use of a firearm in Wisconsin, online records show. He received probation in that 2015 case, records reveal.

In January 2021, he was accused of second-offense drunk driving, but the case was dismissed on a prosecutor’s motion.

He was found guilty of a 2019 forfeiture for obedience to officers and loud noises in Ashland, Wisconsin.

A police report in West Allis, Wisconsin, accused him of “lurking” in an area where police in that suburban Milwaukee community keep their private vehicles, videotaping them.

Why has he not been charged???

Updated to a cut without the language warning...
Certainly the murder charges should be a directed acquittal.

Reminds me of the scene in "A Few Good Men" when Tom Cruise has Jack Nicholson on the stand and gets him to admit he ordered the code red.

You got that right. The headlines for David Muir's ABC World News 45 minutes ago included, as the second item, something to effect of "Dramatic testimony today in the Kyle Rittenhouse trial in Wisconsin where the survivor said...he thought he was going to die." The last 6 words read slowly with announcer-voice gravitas.
