I have no idea what that means but the “National Guard” is always at the president’s “disposal”, providing he wants to issue the activation order..and pay for the call up.

The National Guard is organized as a federal military reserve force, part of the militia of the United States (not the individual state) but is organized at the state level. The feds pay for the equipment and expendables, And for quite a bit of the training. The state governor can use the guard and equipment for certain activities, but The state hast to pay the feds back for anything lost or expended. And the president’s authority trumps (heh) the governor’s If there’s a disagreement.

Texas has a State Guard That is completely state funded and independent of the National Guard; I don’t know if Virginia has the same, but I’ll bet they would be even less inclined to interfere with second amendment sanctuaries.
I have asked the highest officers in the TXSG and no, they would not. Keep in mind, the TXSG in their last modification of contract in the Texas House added that Trump CAN CALL US UP.

We are still in the speculation stage for how this might play out. First, they have to actually pass laws. Then we can see what is in them. They initially said no grandfather clause but the latest I heard was that there would be one. Assuming that, the ban would be on future sales. That would mean that all current gun shops in VA could no longer have the banned weapons. it could be a possible flash point where a local gun shop decides not to comply and someone at the State level tries to hall the local sheriff up on charges for not attempting to enforce the ban.

But I think a more likely flash point is going to be the "paramilitary training" If I'm understanding correctly, the way that the proposed law is written, it would ban all types of martial arts training. There are a lot of dojos in Virginia that probably wouldn't go along and that is where the sheriff may or may not take action. It could be a big popcorn tub event.

Last I read somewhere, to get grandfathered would require registration.

That law has been on the books in Virginia since 1987. The proposed bill is to amend that law to prohibit marching or demonstrating with firearms with the intent to intimidate. That's rife with its own problems.

Registration makes future confiscation much easier. We should consider that all of us are Virginians. Texas progressive socialists want nothing more than to enact the same laws here.

Grandfather clause is how we lost full auto.

Absolutely not going to be accepted. Gun shops should keep selling and refuse to comply.

I am no more in favor of the grandfather clause than any of you. My point with it is that it takes away the initial confrontation that Northam promised in confiscation. Connecticut did the same with their law and, if you believe the numbers, almost none of the banned gun owners complied. The standoff has continued, with neither the State police kicking in doors as they promised to do nor the citizens openly displaying the banned guns.

In the news this morning, a small town in Northern New Jersey has jointed in declaring itself a sanctuary area. I lived in that town - West Milford - many years ago and would never have expected it to be that forward. There are parts of Southern New Jersey who would easily identify with their Virginia brethren on defying the Blue politicians. The same is true for the Eastern and Western parts of Maryland. Maryland also had passed the ban on some weapons and magazines and a Federal Appeals court threw it back to them in 2016. I haven't followed anything about that since. My expectation is that, without implied immediate confiscation, Virigina's laws will fair no better with the population than the in the other States who have tried.

My VA-based BiL will be here for New Years.... I'll have a face to face chance to gauge his commitment to resisting... He's a huge hunter, but not much of a gun-toter. Keeps talking about getting his license. I tease him about it all the time... "Your sister has hers. Already had to renew it twice." :lol:

Would be good to have a warm place to stay if I need to go to Richmond. :patriot:

Let’s compare notes after the New Year...I’ll be in VA visiting the son and family starting tomorrow. I have a meeting set up with a federal LEO friend who lives in VA...he is furious and is counting the days to his retirement.’

Here is a different approach.

This podcaster claims that the nullification of the Virginia proposed gun control laws should focus NOT on the U.S. Constitution but on Article 1, Section 13 of the Virginia Constitution.


He says, however, that it really doesn't matter because this not really legal issue but more of a Public Relations one. The State officials understand that sending the Virginia State Police to try to enforce these laws when the local constables will not will cause massive election losses.

There is a reference to a book which talks about nullification that predates the Constitution. Here is a link to that
