Carrying on Campus

#1

Post by TexasTornado »

Yesterday was my first day of actual classes carrying on campus and it so nice to not have to choose between my education and my second amendment rights for a change.

None of my professors tried to ban weapons from the classroom; although, I do expect one of my class buildings will be posted at a later date. The biggest mention I had was one professor who said weapons weren't allowed in his office. As his class is the one I'm dropping it was a non issue for me personally, but I am eager to see the AG take this power from professors based on some of the comments made during the UT classroom lawsuit.

Overall it was a good experience.

I would report the professors comments anyway, even if you aren't directly affected, someone else may be. Also if he thinks he has the authority to arbitrarily ban guns, it may lead others to try the same thing. If his office is not listed by the University as a prohibited area, I would file a complaint with the University President.

Just be careful. I have it on good authority that despite your abilities to allow others to exercise their first amendment rights out in the real world, when you get into college classrooms you may be overcome with rages that you haven't needed to control before. If you feel your blood boiling towards a tipping point, politely raise your hand and ask about the nearest "safe area." You can go there to recover.

That's amusing to contemplate. Maybe if conservatives started asking for safe places, this particular silliness would diminish.

I carried yesterday to. This semester I only have one class I'm banned from carrying in (Callier Center), but all of my others seem to be good to go thus far. I do agree that it was nice not having to choose.

No then they'll just say now they don't feel safe again. Seriously these people need to suffer actual hardship and persecution to ever learn.

Since all of my classes will be in the ag building I'm pretty good to go. Surprisingly enough I have had two teachers (both agriculture teachers), one last fall and one this summer, openly oppose campus carry. But both of them do seem constitutional enough that I am confident they will not be crossing any lines

What school are you attending. Has the school established a policy that allows professors to ban handguns in their offices?

I don't know of any policies set forth in UTD's recommendation and implementation letters that give Professors the authority to ban their offices. The only off limits areas were resident dorms(minors), Callier Center(patients), sporting events, and the bio engineering and sciences lab buildings(things that don't react well to detonations and projectiles).

*edit* still waiting to hear back from the commission regarding my question about their definition of "printing", and it's resulting disciplinary actions.

Yes, UTD added the ability for professors in single occupancy offices to ban into the policy. Snuck it in last minute. I'll see if I can find the email.

Edit: added photo of email.

I wouldn't have expected that from them. The one teacher who banned his office was a creative writing professor....and probably a Hillary supporter.

AndyC wrote:I carried on the UTD campus yesterday too - no issues.

The section about sole faculty offices can be found in UTD's Campus Carry FAQ: http://www.utdallas.edu/campuscarry/faqs/
Is campus carry allowed in University offices?

Solely occupied offices can be designated as exclusion zones, prohibiting the concealed carry of a handgun in that space. If occupants choose to exercise this discretion, they must provide oral notice that concealed carry is prohibited in the office. Oral notice is the only legally effective way to provide notice about the prohibition. Written notice or the use of signage does not satisfy notification requirements.

What does “oral notice” mean?

The faculty/staff occupant of an individual office should say to each person entering the office, either:

“Pursuant to Section 30.06, Penal Code (trespass by license holder with a concealed handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter this property with a concealed handgun,” or
“The carrying of a concealed handgun is prohibited in this office.”

How frequently must “oral notice” be given?

A faculty/staff occupant of an individual office that chooses to designate the office as an exclusion zone is responsible for ensuring that all persons who enter the office receive oral notification that the carrying of concealed handguns is prohibited in that office. The faculty/staff occupant should determine how frequently oral notice must be given in order to ensure that all persons have received it. Faculty should be mindful that announcements made in class at the beginning of a semester may not effectively reach all students due to absences or add/drops. To err on the side of caution, it is recommended that oral notice be provided each time a person enters the office.
I imagine that's going to become rather tiring for those folks
:iagree:

Yeah by the time they get through that speech, They won't have time to see any students in their office. I hope that they enforce that rule, and have students file complaints, if the rule is not followed to the letter. The professor that Texas Tornado posted about, obviously decided that he didn't have to follow that rule.

Unfortunately the whole UT system also thinks he has that right. I'm sure the AG will sort them all out sooner or later.
