The topic pretty much says it all. I have an LTC that was issued very recently (last week) by the DPS, which obviously included an FBI background check. When I tried to buy a firearm in a store, I was denied. I've already appealed through the FBI's NICS appeal process, but cannot fathom why this would happen. I've never been detained, arrested, or had anything but pleasant interactions with law enforcement. I have no restraining orders, am not a drug addict, etc.

Anyone had this happen to them before? What's the deal? I went to the store again today and provided my SSN on the form (I didn't do that the first time around because I'm not comfortable with that, but relented on the chance that maybe they just couldn't correctly identify me). This time, today, it came back "deferred", which means they're going to review the request again.

The store owner asked if I've ever held a security clearance, and when I replied in the positive, she stated "that's probably it, but you never know with these bureaucrats".

So here I go, waiting again... hoping you all have some insight into what the issue could possibly be.

For what it's worth, this is from the FBI's NICS Appeals page:
A federal prohibition would exist for any person who:
[*] Has been convicted in any court of a crime punishable by imprisonment for a term exceeding one year
[*] Is a fugitive from justice
[*] Is an unlawful user of or addicted to any controlled substance
[*] Has been adjudicated as a mental defective or committed to a mental institution
[*] Is an alien illegally or unlawfully in the United States or who has been admitted to the United States under a non-immigrant visa
[*] Has been discharged from the Armed Forces under dishonorable conditions
[*] Having been a citizen of the United States, has renounced U.S. citizenship
[*] Is subject to a court order that restrains the person from harassing, stalking, or threatening an intimate partner or child of such intimate partner
[*] Has been convicted in any court of a misdemeanor crime of domestic violence
[*] Is under indictment for a crime punishable by imprisonment for a term exceeding one year
None of which applies to me - not even close.

Just curious, but why are they running you through NICS when you have an LTC?

Odd they even checked with the FBI if you had a CHL.

Maybe having a security clearance without having an unpatched email server in your guest bathroom raised red flags. Could be something as simple as that. :biggrinjester:

I'm with the others....you have an LTC, they shouldn't be running LTC's through NICS.

That would make me scratch my head as well. I'll be following as I'm curious to see the outcome.

And, yes... with a CHL, the NICS check is bypassed. The CHL proves you have already passed that test ;)

Common enough, I suppose. I've known a few people with my name in my life, but not many. There's probably several hundred people with my name in the country, some of which may be criminals.

This is probably exactly it. Thinking of rigging up a server sometime soon, running for President, berating the Secret Service, beating my spouse, then stealing furniture and other artifacts from the White House on my last day in office. I'll probably even pardon like 150 people on the last day, for laughs. Pretty sure I'd be getting National Security briefings by all the three-letter agencies if I did that.

The ATF themselves say a valid Texas "concealed weapons permit" is an alternative to the background check: https://www.atf.gov/rules-and-regulatio ... rmit-chart

I bet $50 on human error. The clerk pressed a wrong button.... Ex clicked yes when you said no and put it into automatic review/denial. Tried it again with the correct answer and it was flagged....

Very nice - thank you. This is great ammo for me to bring to the store and say, "please sell me the weapon". I've already put some cash into it on a layaway program. Great people, so I'd like to do business with them now and into the future. With so many rules and regulations for small businesses to follow, I wouldn't be surprised if they were just unaware of this.

If you are denied, are they not suppose to give a reason?
Texas LTC Instructor, NRA pistol instructor, RSO, NRA Endowment Life , TSRA, Glock enthusiast (tho I have others)

I just reached out to the owners to ask them about the ATF link you sent - I'm hopeful about all of this, and will keep you all informed.
