Assisted Living/Rehab Facility
Need some help please. I am getting ready to go the The Buckingham or The Plaza at the Buckingham(re-hab) and prefer to carry concealed.
I have checked Texas3006.com and see no listing for this facility. It is located off Westheimer and Fondren. I believe there would have to be 3006 signage for this facility to be considered off limits. During my CHL course our instructor, Charles Cotton, indicated hospitals and nursing homes were off-limits to CHL holders with proper signage displayed.
Any quick help would be greatly appreciated. I hate to have to leave my gun in my truck.

You remember correctly. If not posted, you may carry.

Re: Assisted Living/Rehab Facility
I don't have any info on the Assisted Living Facility you mentioned, but I do know that a lot of them are posted, but because of the normal clientele, they may not be listed on Texas 3006. Most people who live in an assisted living facility don't usually keep their guns. Please add them to the site if they are, I have added one that I ran across.

Re: Assisted Living/Rehab Facility
Well, it did have both the 30.06 and 30.07. Proper signage legally displayed. Decided to unholster my gun and stowed it away in the console. The facility is gated so I was fairly comfortable doing so.
I will post pics of both 30.06 and 30.07 on Texas3006.com

Re: Assisted Living/Rehab Facility
I believe there is an administrative law that specifically bans firearms from assisted living facilities.

Re: Assisted Living/Rehab Facility
How would one go about finding out if it is illegal to carry at an assisted living facility ? My mom lives at one and I never thought twice about carrying when I go visit, I carry concealed so it has never been an issue.XDFan43 wrote:I believe there is an administrative law that specifically bans firearms from assisted living facilities.

I didn't recall anything to that effect, and just did a few different searches of state statutes with no results. If anyone finds such a law, please cite it here.XDFan43 wrote:I believe there is an administrative law that specifically bans firearms from assisted living facilities.

Get out your copy of the CHL-16 (http://www.dps.texas.gov/InternetForms/Forms/CHL-16.pdf) and go to section 46.035. Paragraph b-4 says no carry in a hospital or nursing facility....BUT paragraph (i) says the section does not apply to b-4 IF YOU ARE NOT GIVEN NOTIFICATION by 30.06 or 30.07. If there is no sign,
carry away.

Re: Assisted Living/Rehab Facility
That's not what XDFan43 was referring to; it was one of the administrative codes, not the penal code. That's why I asked for a cite, because I can't find a pertinent reference anyplace but the penal code.howdy wrote:Get out your copy of the CHL-16 (http://www.dps.texas.gov/InternetForms/Forms/CHL-16.pdf) and go to section 46.035. Re: Assisted Living/Rehab Facility
Administrative Regulations prohibit carry in the following area: a. Assisted Living Facility (Tex. Health & Safety Code Ann. Section 247.065(b)(9); Tex. Admin. Code Section 92.125 (b)(2)(I). Quoted from the Legal Heat android app regarding Texas prohibited areas. These codes refer to the Provider's Bill of Rights (pertinent section in quotes) accorded to people in their care, i.e., "maintain an environment free of weapons and drugs."
