Hah! This is in Bexar county. MAYBE a slap on the wrist, but I'd be just about willing to bet no charges because nobody was hurt and the value of the property was less than $20. Besides, losing his job was enough punishment for the perp.

In that part of Texas, I'm just glad the cops didn't arrest the teen for disturbing the peace. Although I guess they could still send a joint department SWAT team to raid his house and seize his phone, computer, and any cameras.
God, grant me serenity to accept the things I can't change
Courage to change the things I can
And the firepower to make a difference.

srothstein wrote: Thu Jul 05, 2018 11:24 am The news article I read says that a police report has been filed. It implied that it wasn't filed until after he was identified, which i can see as most teenagers probably would not have thought of it at first.

But it won't be a fine, if true. I see it as one of the easiest felony arrests some SAPD detective will ever get. When you combine an assault with a theft, you get a robbery. The video is pretty good evidence of both elements of the offense. The public has identified the suspect. All the detective has to do now is get the statement from the victim, put together an affidavit for a warrant, and go pick up the suspect. I am sure the DA would then bargain it down to a lower offense, but it is hard to not make it at least a state jail felony for theft from a person.

And while it is legal to shoot to stop a robbery, I would not recommend it for anyone in a case like this.
That was my thought when watching the video. Can't shoot to stop, but if an LTC stepped in to stop it and confronted the adult non-violently, and the subject escalated the situation, I wonder how that would go across in a grand jury. Would the LTC be considered an instigator, or a defender? :confused5
No guarantee that the DA or the GJ would be logical (which is always the case), but if someone stepped up and told the punk to give the kid's hat back, maybe stood in the aisle, and punk escalated to violence, I don't see why "someone", LTC or not, could not defend himself within the law. As srothstein said, there was an assault and a theft. Might not be tactically wise to intervene, but that's a different issue.

Now if the DA or the SAPD does NOT act on this, with all the publicity it's getting, they are saying it is open season on Trump supporters in San Antonio, and it will be time to step up one's defensive strategies.

This is an article that identifies the punk, and I think his case should be tracked closely, including three months down the road when the newscycle has rolled over about 1000 times and his lawyer is trying to get charges dropped or pled down to class Z misdemeanor mopery.

Another interesting thing was reading the comments on the news pages....local Hispanics saying that they were proud to have voted for Trump and they were calling out others who were backing up the "bad guy" saying the kid "shouldn't have worn the hat in a heavily minority city".
I hope someone pointed out that this is exactly like saying that a black kid should not be walking around in a white neighborhood.

People need to learn that other folks will occasionally disagree with them on a variety of topics. Some folks can't control their emotions or their actions when they encounter someone who believes differently than they do. Those folks belong in prison.

And to the post up thread, I agree that shooting this scumbag would have been a bad idea. But it is a reminder for why we should always be armed. There is no way to foresee exactly how things might have escalated if someone had done the right thing and tried to prevent this criminal from fleeing the scene.

Watching the video and having the safe environment of home for processing makes it obvious the teens are being assaulted. Sometimes things like that developing right in front of you when out in public takes a bit of time to process. I have been witness to assaults that I did not realize were assaults at first sight. It is hard to know what any of us would do or say unless sitting at that place in a booth as it unfolded. It is likely that the right "types" sitting in that place would have kept the bully from feeling such bravado.

:banghead: Great, you think he'll think twice before doing it again? Nope. Letting him walk without consequence will just embolden him.

Subject to the usual caveats and it depends---teenagers do not get to decide what a District Attorney or County Attorney decides to do with a case.
Please know and follow the rules of firearms safety.

Correct. And in this case, they have the video.

If the DA decides to not prosecute, or offers the attacker a much lesser charge (what ever would be the lowest possible charge so that no one can claim he straight refused to prosecute) Does the victim have any recourse? I get a DA and victim may disagree if there is sufficient evidence to charge and prosecute...likely it happens often.. But what about when the DA simply chooses not to, just because that's what he wants to do?

If there are no consequences to this activity that Maxine Waters promotes then he and others are going to be emboldened to continue and escalate their crimes.
The left lies about everything. Truth is a liberal value, and truth is a conservative value, but it has never been a left-wing value. People on the left say whatever advances their immediate agenda. Power is their moral lodestar; therefore, truth is always subservient to it. - Dennis Prager

Unfortunately karma has gone off the rails. His addresses was posted online, except it wasn't his, or at least not for a good number of years. It's his brother's now. People have been showing up at the house making threats and the police have been called often enough that they've parked a unit there. Dozens of unordered pizzas have shown up. I'm waiting to hear that the address was swatted.

To me, this behaviour is as bad as the original action.

It may be just as bad, but it's actually worse in the eyes of the original bad actor. He won't see it as just karma; he'll see it as a declaration of war from the alt-right. His "just left of center" views are getting threatened now, so he may go even further left and get even angrier. Hopefully nothing more will come from it.
