Ohio Open Carry

#1

Post by Glock_Tacular »

Has any members here had a chance to OC while they may have visted Ohio or know of any bad experiences with OC'ing in the state?

I plan to travel there is 2 months and wanted to try to get a heads up of the general morale of OC'ing.

Thanks

I actually just got back from there. I'm assuming you want to open carry due to not have a lisence with reciprocity to allow you to cc there? I oc'ed once while I was there and everything was fine. I was also in a very rural area in the southeast part of the state. I have read about horror stories where people in Cincinnati have been detained and possibly arrested for the "inducing panic" law. Constitutional carry is 100% legal though and they can't prosecute you for it. I guess it just depends on where you do it at. Like any other open carry state, some areas are more friendly towards it than others.

I've open carried hundreds of times in Ohio, mostly in the Columbus area. Have numerous friends that still open carry there today.

The biggest landmine you face is vehicle transport. Unlike Texas MPA, one must have a CHL to have a loaded handgun in a vehicles in Ohio. That means you need to unload the gun before you get in the car. A loaded gun in a case in the trunk is still a loaded gun and a felony. There are nuances to the word "unloaded". Basically unload the gun and store the gun and loaded magazine in separate cases that close with a snap, buckle or lock. Glovebox or console does not suffice.

No carrying in government buildings, churches, or schools. No unlicensed open carrying where alcohol is being served.

Other than that and a few other pitfalls, unlicensed open carry is 100% legal.

If you encounter any police officers named Richard (most are not) be aware that threats of "Disturbing the Peace" and "Inducing Panic" are 100% bogus. Legal open carry does not meet the statutory definition of those crimes and there have been numerous DA memos and training bulletins to LEO's notifying them of that.

Appreciate the detailed info Frog. And I do have a Flroida non-resident license, so I think I'll be ok with my loaded firearm in my car. I also did see that they passed a law about carrying in an establishment that has a Class D liquor license. The more I researched about the bill it seems that carrying in bars and resturants that sell alcohol wont be an issuse. BTW I'll be in the Northeastern part. Akron, Cleveland...ect.

Also, I'm not sure if y'all saw the letter that was sent to Greene County Sheriffs Department about what to do if someone calls and complains about someone OC'ing.

It's on the Home page.

You didn't say in the first post that you had a license that reciprocates with Ohio.

That changes everything. You can carry open or concealed anywhere that is legal. You can carry in any bar or restaurant (but you cannot drink while armed in a liquor establishment). There are no restrictions on how you can have your loaded handgun in a car.

You still cannot carry in government buildings, schools or churches. Unlike TX, schools also forbid carrying anywhere on the property.

Have fun.
