Hunting of any kind is banned in all village, town, county and state parks in Rockland

Why? They give no reason for this at all.

I don't know of any park where hunting is allowed, and certainly not close to residences.

The reason is specifically to prevent incidents like this. There are enough stupid, careless hunters to make hunting incompatible with other recreational activities.

I guess this is because where I grew up, all the large forest areas in the area were 'state parks', and that's pretty much primarily where we hunted, and this was in NY State.
I guess it's on a park-by-park basis, but all the large 'forested' parks I knew of were hunting allowed.

Muskegon, Michigan -- A defendant pleaded guilty last month and was sentenced Monday to seven months in jail, five years on probation and ordered to pay $2,354.75 in restitution for shooting a dog.

Authorities say he shot the dog not because she posed any threat to him, but because he mistakenly believed she belonged to his next-door neighbor, a man he disliked.

As conditions of his probation, [he] must give up all weapons. He also must perform 200 hours of community service, complete treatment programs for psychological and medical issues, and complete anger-management training.

Pittsylvania County, Virginia (middle of nowhere) -- A man was sentenced to 18 months in prison for shooting and killing his neighbor’s dog.

The defendant pled guilty to shooting at an occupied dwelling, malicious wounding of an animal, reckless use of a firearm, and property damage. He pled no contest to shooting from a motor vehicle.

The judge suspended eight years and six months of the 10-year sentence.

FBI agents attempted to carry out arrest warrants on an Islamic group in Dearborn, Michigan, a suburb of Detroit. The leader of the group and target of one of the warrants shot and killed a 3-year-old Malinois police dog named Freddy.

The shooter paid with his life.

Please note, the suspect was an American-born convert to Islam. He and the group that he led were indicted for criminal activity and planned terrorism. This incident has exploded into racial and religious controversy in the Detroit area.

Galveston PD has a Malinois. They are not a dog that anyone would want to tangle with.

Fond du Lac, Wisconsin, Tuesday, 32-year-old Lac man was charged with shooting and killing a neighbor’s Jack Russell terrier with a pellet gun. He reportedly stated that he shot the dog because it barked at him.

Sylva, North Carolina (edge of nowhere) -- A 24-year-old man was charged with two counts of felony cruelty to animals and misdemeanor "going armed to the terror of the public" (the names of offenses in some states are a hoot).

A 41-year-old woman who allegedly drove a vehicle that the man was riding in was charged with aiding and abetting.

Apparently, it was not the man's first issue involving animals in the criminal justice system.

Cherryville, North Carolina (middle of nowhere), yesterday, a man allegedly shot his neighbor's dog for barking too early in the morning.

Three pistol shots allegedly didn't complete the job, so the shooter allegedly got a rifle.

The dog is allegedly dead, Jim.

The alleged shooter was arrested and is facing criminal charges.

Elizabethton, Tennessee (edge of nowhere), Saturday, a man allegedly shot a neighbor's dog and then allegedly threatened the neighbor with a weapon.

Alleged man was arrested and charged with aggravated assault, reckless endangerment, and aggravated cruelty to animals.

A pattern here seems to be that in almost every case, there were other criminal acts committed in addition to the dog slayings. [Shooting from a vehicle, shooting into a neighbor's property, pointing a gun at a person, discharging a firearm in a prohibited area, etc]

I'll be curious to know if there are any plain vanilla cases where someone gets convicted of dog killing with no other charges added. i.e. the guy on his own property shoots a dog that is also on his own property, in an area where shooting firearms is perfectly legal.

For the most part, you won't hear about someone shooting a dog on his own property where it is legal to shoot. That's because the only places where it's legal to discharge a firearm are rural, and the neighbors are less likely to get jumpy at hearing a gunshot. Furthermore, if you have enough land to shoot, you have enough land to bury a dead dog with no one knowing.

Discharging a firearm in a prohibited area is a minor misdemeanor (class B or C for the most part). What got most of these people was the wounding or killing of the animal (felony animal cruelty) or something like reckless endangerment because they shot toward a human being or dwelling.

And this is the first I've heard about the FBI raid on the criminals place. Thank goodness they did. No telling how many people would have died by these hardened thugs had it not been for the FBI. They got this one right.

Tyler, yesterday. Two adult brothers who lived in the same house owned dogs. One dog was tied up. The other, a reported "pit bull," attacked it. After the owner of the dog that was attacked was unable to separate the dogs, he fatally shot the attacker.

His brother, owner of the dead dog, came out with a firearm and shot up the other brother's truck.

When police arrived, neither brother would press charges and neither was arrested.

The one brother certainly had the right to protect his dog from the pit bull, so he didn’t do anything illegal.

The law specifically permits shooting dogs that attack livestock. (In fact, that law is the only one that I know of that allows a person to administer lethal punishment after the fact.)

Of course, this law has probably been in place since the early days of the Republic, when raising livestock was a livelihood for many people.

Shooting a dog that is attacking another animal is justified by the general principle of necessity.

This is a good example of the police applying the law correctly without a lot of legalistic parsing.
