Taco Palenque 51%?

Had one open nearby to where I live. I go to Laredo quite a bit so was familiar with the chain. Little bit pricy but I prefer it over taco cabana. Anyway I've been inside 3 or 4 times and never saw any types of signs at any of them. My son chose and odd seat where I happened to notice a 51% sign high up on a window intersecting the door. It's well over eye level. Had he not have chosen this table I would have never noticed it. I was shocked. I don't see any way this franchise could possibly have 51% of sales in alcohol when 4 breakfast tacos and 2 drinks are 16 dollars. For reference it's very similar to taco cabana in setup. Meaning every time you want a drink you go stand in line again. Could this be a bogus sign?

After checking the
TABC's website the only one I see with a red sign is in San Antonio on N. 410.
Which location did you visit?
If it is not the 410 location you can report them to the TABC via the website. It has been suggested that you not comment on LTC, 2nd amendment, or similar topics as the TABC does not seem to friendly in these areas. Just tell them you think the sign is not correct. They will check on it and if it is wrong they will correct the issue quickly.

I10 utsa Blvd right before 1604. Blows my mind that someplace with a majority of revenue from a drive through is 51%.

As troglodyte suggested, look them up on the TABC website. If the license calls for a blue sign, fill out the complaint form through the link on the site. I did this recently and got the sign removed, although it did take 4 months.

Will do, appreciate the replies. In relation to the sign, I thought it had to be on the door as you walk in?

If they were following TABC rules, it would have to be on the door. But, they might like it sort of out of the way since it's obviously not supposed to be there. I've seen the same thing before with a 51% sign that wasn't supposed to be there.

I tried them right after they opened up in the old Taco Bueno location in New Braunfels. Wasn't impressed and I never went back. That was quite a while ago and I don't remember if they had any signs.

There is another possibility. When a new business applies for a license and has no sales history, the TABC takes the owners projected sales to determine 51% or BLUE. Even if the estimate is wrong, the place stays 51% until renewal time, and then actual sales history can be evaluated.
Regardless, many owners do not understand the law and post the wrong (or both) signs. You should look up their license on the TABC app and report them if they are not in compliance.

My understanding is the 51% sign can be posted anywhere. It's the 'other' sign that must be on the door. When you walk into the place you know sells booze and don't see the 'other' sign on the door the 51% will be hiding somewhere. I could be wrong but it was explained to me like that. Can someone please confirm.

Actually, it's the other way around. A 51% sign is to be posted at each entrance per the Alcoholic Beverage Code 411.204:
Sec. 411.204. NOTICE REQUIRED ON CERTAIN PREMISES. (a) A business that has a permit or license issued under Chapter 25, 28, 32, 69, or 74, Alcoholic Beverage Code, and that derives 51 percent or more of its income from the sale of alcoholic beverages for on-premises consumption as determined by the Texas Alcoholic Beverage Commission under Section 104.06, Alcoholic Beverage Code, shall prominently display at each entrance to the business premises a sign that complies with the requirements of Subsection (c).
(b) A hospital licensed under Chapter 241, Health and Safety Code, or a nursing home licensed under Chapter 242, Health and Safety Code, shall prominently display at each entrance to the hospital or nursing home, as appropriate, a sign that complies with the requirements of Subsection (c) other than the requirement that the sign include on its face the number "51".
(c) The sign required under Subsections (a) and (b) must give notice in both English and Spanish that it is unlawful for a person licensed under this subchapter to carry a handgun on the premises. The sign must appear in contrasting colors with block letters at least one inch in height and must include on its face the number "51" printed in solid red at least five inches in height. The sign shall be displayed in a conspicuous manner clearly visible to the public.
The 'Unlicensed possesion sign just says 'displayed in a prominent place' (two sections state the same info):
Sec. 11.041. WARNING SIGN REQUIRED. (a) Each holder of a permit who is not otherwise required to display a sign under Section 411.204, Government Code [Refer to Appendix for this citation], shall display in a prominent place on the permit holder's premises a sign giving notice that it is unlawful for a person to carry a weapon on the premises unless the weapon is a [concealed] handgun the person is licensed to carry under Subchapter H, Chapter 411, Government Code.
(b) The sign must be a least 6 inches high and 14 inches wide, must appear in contrasting colors, and shall be displayed in a conspicuous manner clearly visible to the public. The commission or administrator may require the permit holder to also display the sign in a language other than English if it can be observed or determined that a substantial portion of the expected customers speak the other language as their familiar language.
