buying new gun and leaving same day without a CHL

I have a friend who bought a gun at Bailey's House of Guns just off 288 & the beltway. He didn't have a CHL and left with the gun (pistol) the same day. In fact he said it took him longer to decide which one to buy than to get approved for purchase.. For the people on this board who are in the know, have we got so fast that background checks are made same day in minutes? Has the process for someone without a CHL speeded up that fast. Just curious to know...

I've never had a background check take more than 15 minutes. Now that I have a CHL I don't think they even have to do even those checks.

A call to NICS usually goes like this;

You give your FFL number and Password. They ask how many names. They ask questions that are answered by the purchaser on the form.

Within a few seconds after answering all of the questions, they give you an answer;

1) proceed

2) Delayed, NICS will call back within 3 business days, if not, you can release gun on this date, "xx-xx-xxxx"

3) denied


4) this request will take further review, please hold for an examiner;

then another person gets on the line and asks a few more questions, then gives you an answer of either one thru three above. I have never had it take more than 3-5 minutes.

Just from my own, unscientific observation, it appears that about 98% of what we did was proceed, 1.5 % delayed, and .5% denied.

Yes, without a CHL and assuming you pass the NICS background check you can walk out the same day with a gun.

Walked into the Big Town gun show in Mesquite. Walked around about an hour or so. Found the dealer with the lowest price that I agreed with. Said Ill take that one and was at Target Masters in Garland about 40min later. The check was so fast that I was talking to a friend that I was with and next thing I know she handed it to me and told me to have fun shooting it. She wasn't on the phone longer than 5mins. That was on a Sunday Morning.

I DO NOT HAVE A CHL YET Dang processing Application.

If what you are looking for is a waiting period you will not find one in Texas. Just like the others have said the FFL calls the NICS to check.

With a CHL the call to NICS is not made.

Yes, it has been that way for years. Thats how it happens at gun shows. If not, I think they would be out of business because a lot arent local vendors.

Yes. There is no required waiting period... and the required background check takes just a couple of minutes.

Recent personal experience.

I don't have a CHL (waiting for it to get approved). I've bought two pistols in the past couple months. Waited less than 10 minutes each time.

My wife doesn't have a CHL. (She is signed up for the class though!) She bought a pistol and had a 5 minute wait.

That's how it happens regardless if you buy it at a gun show or at a gun shop, the process is exactly the same if you are buying from a dealer. Either place has to have you fill out the 4473 form and then call in a background check with NICS (unless you have a CHL of course).

Private sales between individuals which require no background check is what you are probably thinking about.

Yes, a free citizen can walk into the shop of a purveyor of fine firearms, pick out the tool of his or her choice, fill out paperwork, wait for a phone call to be completed, and walk out of the shop with tool in hand.

This is as it should be (except for maybe the paperwork and phone call portion of the transaction, those I would prefer to do without).

From 1994 to 98, there was a nationwide waiting period. It was replaced by NICS.

I think I hear an echo of that in this discussion.

Many states currently have waiting periods.

If we were "free citizens", the only paperwork would be a receipt.

And the process for legal carry would be: 1)Buy a gun; 2)Carry it.

Having the CHL paid off again. I was buying a stripped lower a couple Thursday's back and NCIS had been down for an hour. No waiting for me!
