Resorts that are posted 30.06
this popped into my last night...
Great Wolf Lodge in Grapevine is posted 30.06. When family went there earlier this year we kept our weapons locked in the vehicle....
Now here's my question...
Since 30.06 is applicable if you are carrying concealed, would it be applicable if your weapons are unloaded and safely locked in any luggage you carry in and up to your room...
my reasoning is since you are not carrying under Chapter 411.... then the sign would not have force of law behind it.... if i keep my weapons locked in the room safe and not carrying around the property, then it should be perfectly legal.

I wondered the same thing but leaving firearms in your vehicle because its in your property on theirs

I am referring to any resort and say the gate or entrance is posted

the parking lot as far as i could tell was not posted... the 30.06 is posted just to the left of the entrance doors...
using Great Wolf as an example because this is one place that I know is posted...

I went onto their website and didn't see any notice of their prohibition of firearms. Wasn't there some recently passed legislation (with penalty) about the requirement to have it on their website?RetNavy wrote:this popped into my last night...

The law states that it must be on the reservation website. Going onto the website I don't see it posted anywhere unless, as you pointed out, you go to the bottom and click on Terms and Conditions. To me, it doesn't seem like it meets the intent.MeMelYup wrote:Great Wolf Waterpark, Grapevine, TX.

411.171 (3) “Concealed handgun” means a handgun the presence of which is not openly discernible to the ordinary observation of a reasonable person.
Therefore, I suggest the means of concealment is mute as to whether it be a holster, briefcase or in this post, luggage, nor is the loaded or unloaded state a condition of concealed. Thus, carrying the handgun into the hotel room in the luggage is indeed concealed carry under 411 and a violation of 30.06 for one who holds a CHL or a violation of 46.02 if one does not possess a CHL.

The reason we worked so hard for 30.06 is because any notice is enough for 30.05 violation. I wouldn't play barracks lawyer looking for loopholes. Too risky when many businesses out there want my money. I don't need to give it to companies who dislike customers with clean backgrounds, like the sketchy gun shows that don't allow CHL.

I'm completely unfamiliar with that requirement. Can you point out the item number for me? AN ACT
relating to requiring notice of a hotel's firearms policy and other
guest policies; providing a criminal penalty.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 2155, Occupations Code, is amended by
adding Subchapter C to read as follows:
SUBCHAPTER C. FIREARMS POLICY NOTICE
Sec. 2155.101. DEFINITION. In this subchapter, "hotel" has
the meaning assigned by Section 156.001, Tax Code.
Sec. 2155.102. APPLICABILITY OF SUBCHAPTER. This subchapter
applies only to a hotel that has a policy prohibiting or restricting
the possession, storage, or transportation of firearms by hotel
guests.
Sec. 2155.103. NOTICE REGARDING FIREARMS POLICY. (a) A
hotel shall include on the hotel's Internet reservation website the
hotel's policy regarding the possession, storage, and
transportation of firearms.
(b) If a hotel provides a written confirmation or a written
statement of terms and conditions to a consumer after accepting the
consumer's hotel reservation by telephone, the hotel shall include
information specifying how the consumer may review applicable guest
policies. The guest policies must indicate the hotel's policy
regarding the possession, storage, and transportation of firearms
by guests.
(c) A hotel owner or keeper commits an offense if the person
does not comply with this section. An offense under this subsection
is a misdemeanor punishable by a fine of not more than $100.
SECTION 2. This Act takes effect September 1, 2013.

Have we possibly strayed off topic. It appears to me the OP asked a question about the legality of taking his gun past a 30.06 ban. While the posts about listing a prohibition against guns on the res page of a hotel web site are informative, I do not believe that was the OP's concern.
