Taco Cabana; NO WEAPONS ON OUR PROPERTY
I emailed Taco Cabana about their policy on 30.06 signs. I received this in response.
I am Vice President, Associate General Counsel for Taco Cabana and I am writing because I received your April 16,2007, comment to the company regarding our Concealed Handguns Policy.
First, let me tell you that I appreciate your patronage and that you took the time to let us know how you feel about our policy.
I understand that anyone licensed to carry a concealed weapon has undergone a significant amount of screening and training. I also understand that each of us has concerns about our safety and wellbeing. Taco Cabana has made a decision based on a number of competing factors, to prohibit all weapons from our premises. I believe it is the best we can do to keep our customers and employees safe.
I have confirmed that our interior sign is in full compliance with the posting regulations. In addition, we have placed a smaller courtesy sign on the front door so that patrons are informed of the policy prior to entering the store.
Thank you again for taking the time to let us know how you feel. I know we may not be in agreement on the best method to ensure safety. However, we respect your opinion as our customer and hope that you will continue as our customer and respect our decision.

So Taco Cabana is an official VICTIM DISARMAMENT ZONE. No chl and NO COPS! It's maybe one thing to ban chl. But to ban COPS? I sure wouldn't trust my safety to a place like that. Not even in the drive thru lane.

The reply looks word for word like another that has been posted here before, so obviously Taco Cabana cares so little about our opinions that they probably trash "just another gun nut" letter and send a form letter in response.

The email was in regards to the signs your stores post prohibiting legally licensed person from carrying firearms on your premises.
Here is that response;

While I certainly support a private property owner's right to control the activities on his/her property, I have to ask one question. In the response was this statement; "Taco Cabana has made a decision based on a number of competing factors, to prohibit all weapons from our premises". How does Taco Cabana plan to do that? Criminals are criminals because they do not obey law, much less signs posted by businesses.
Your sign only has the effect of preventing law abiding persons from carrying there; thereby, allowing criminals who will not obey the law nor your signs to know that your patrons and employees are unarmed, defenseless and sitting ducks.
Recent shootings were all done in violation of the law, and committed upon defenseless people obeying the law.
Unless you install metal detectors and people to man them, your policy does not prohibit "all weapons from your premises". It only prohibits those that could be lawfully carried by your patrons who might find themselves face to face with a lawbreaker intent on murdering your customers and staff.
By the way, I am just a father, business owner and Concealed Handgun License Instructor who believes I have a duty to protect my family. Unfortunately, your company policy prevents me, and thousands of other CHL holders from being able to do that in your restaurants in the event a lunatic or criminal were to try to kill us.

Actually, it is the way you read 30.06 that is causing the confusion. 30.05 requires the notice to be at the entrance, but 30.06 just requires it ot be in plain view. It does not specify at the entrance or at every entrance or any specific location.
I have thought before that most people are reading ti wrong when they think it has to be at every entrance to be valid but I was hoping I was wrong. Here is a company whose lawyers are at least reading it the same as I do.
Here is the exact language they are refering to:
(3) "Written communication" means:
(A) a card or other document on which is written language identical to
the following: "Pursuant to Section 30.06, Penal Code (trespass
by holder of license to carry a concealed handgun), a person
licensed under Subchapter H, Chapter 411, Government Code
(concealed handgun law), may not enter this property with a
concealed handgun"; or
(B) a sign posted on the property that:
(i) includes the language described by Paragraph (A) in both
English and Spanish;
(ii) appears in contrasting colors with block letters at least one
inch in height; and
(iii) is displayed in a conspicuous manner clearly visible to the
public.
Note that it requires just posted on the property conspicuously.

I'm pretty sure he only means that since the majority of your responses are very brief, the effort put forth to write a well thought out and poignant letter to the company, seemed a little out of character. I don't think he intended to mean anything negative by it. We don't know you from Adam and personalities are difficult to decipher just from forum postings.
I'm just glad to see more folks taking a more active roll against companies that have flawed policies created by inept people. Keep up the good work, guys.
