Spurs/Heat Game 6

Long time lurker, first time poster...

Game 6 is being held in Miami, so San Antonio is hosting an event at the AT&T center to watch Game 6 with a few thousand of your closest friends. Would CHL holders still be prohibited? My thinking is "no" because no sporting event is actually being held, just a big TV set.

NOTE: The AT&T Center is city owned AND improperly posted with 30.06 signs. I know there have been plenty of discussions on city-owned buildings and 30.06 signs--that is not my question. I am only curious what the consensus is on whether concealed handguns would be permitted.

My opinion, and my opinion only: I would not carry in the AT&T center for anything that looks like a sporting event.

If watching a sporting event prevented chl carry then a lot of restaurants would be off limits, but beings it does not then i would carry away. That is if they aren't wanting people of course as they will likely not let you in, right or wrong.

First, welcome to the group and discussions.

Secondly, you have managed, IMO, to come up with a very interesting question. We have had a few discussions in the past on what is meant by a sporting event, but I don't think any have ever approached the question in this manner. In addition to questions about whether rodeo or car racing are sports, we have, IIRC, discussed things like pregame shows like free throw competitions. I think this one would be the most gray area of that definition.

One would normally think of the sporting event as the actual game, but an argument could certainly be made that the game could be televised and still be the event. It is clearly sports, and it is an event sponsored by the team. But if that were true, then many of the sports bars that host parties to watch the game might also be off limits based on the law. As a comparison from a different sport, simulcasts of races from other tracks are allowed at race tracks here, even when there are no live races going on. They are still off limits as race tracks (and yes, that is worded differently in the law since race tracks are kind of like schools in maintaining their status).

The law says that you need to look at the intent of the legislature when the law is not clear. In this case, the intent was to prevent trouble between fans that took the game too seriously. That could argue that the center should be banned.

I would think a jury or appellate court would say that the intended event was the actual competitors, but I can see arguments that could be made the other way. Since I advise against being test cases (and owe my gratitude to those who volunteer for this), I would advise against carrying. But it is an individual choice to be made after considering the arguments.
