Man fatally shoots an alleged intruder

An eastern Kentucky man fatally shot one of two alleged intruders who claimed to be police officers, according to sheriff's officials.

The other suspect was arrested and charged with burglary and impersonating a police officer, a sheriff's report said.

Jason Daniels, 23, of Ashland, shot Robert Lewis Chapman, 50, of Greenup in the chest, shoulder and wrist Wednesday night, the Boyd County Sheriff's office said.

Adam C. Justice, 22, of Summitt, was lodged in the Boyd County jail.

Boyd County Sheriff Terry Keelin said a grand jury would decide if Daniels would be charged.

The intruders allegedly broke into a home where Daniels was staying after Daniels refused to answer the door. The men had pounded on the door claiming to be police officers with a search warrant, Keelin said.

The men then tied Daniels up in the bathroom and ransacked the house, the sheriff's report said. Meanwhile, Daniels freed himself and got a 9 mm pistol from a cabinet, the report said.

"When the suspects returned to the bathroom, they found Mr. Daniels, now armed and in a shooting stance," the report said.

When one intruder attempted to draw a revolver, Daniels fired four times. Both men fled in a van parked nearby.

Chapman was dumped outside the emergency room entrance to Kings Daughters Medical Center about three miles away and later died, the report said. Police stopped the van a few blocks from the hospital and arrested Justice.

It may be that a grand jury is required in all shooting deaths.

Its the law. ALL cases where a person kills another go before the Grand Jury. This means neither the police nor the DA are charging the guy.

Now on a personal note, I'm glad I'm not the only one to use a Tillia FoodSaver on gun stuff. I never admitted that before, but now that txinvestigator has come out of the, er, shower...

I started buying most ammo by the case a year or so ago, and I transfer the cartridges to 100-pack, plastic CaseGard containers. Then I got the bright idea to stack 'em two-up and vacuum-seal 'em. I figured, "Why not?" The bags aren't that expensive, are resuseable, and in Houston there's a greater threat of flood than fire. Keeps my cartridges pristine, and if we have a Katrina or Rita, I'm good to go without worrying about how to keep my ammo dry. It's also a great way to store a hangdun if you plan to pack it in the safe and not use it for a few months. Takes all of about 20 seconds and air and moisture can't get to your gun.

I don't have one hanging over my showerhead, though...

The only way i could do it would be to also place a safe in every room.

I wont just hide a gun anywhere in my home for fear of coming home and finding the door or a window broken open. I wouldnt want someone to find any gun i had "hidden" in my home.

It doesn't state whether or not the impersonators were uniformed or had parked a fake squad car out front - if so, that would give anyone pause.

If not, consider:
The intruders allegedly broke into a home where Daniels was staying after Daniels refused to answer the door.
Forced entry, no squad car or uniforms to provide identification = justified immediate defensive gunfire from resident as soon as they cross the threshold.

That things turned out the way they did for the resident after allowing himself to be tied up is pure luck.
