Carry in Church

When I took my CHL class, my instructor told me that unless the church has posted the 30.06 sign on the building or in the bulletin it is legal to carry in a church, however when I read the statutes, it says that a person commits an offense if they carry in church. Can you guys clarify for me?

Read the entire statute... particularly (i).

So you are referring to this?
(i) Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor
was not given effective notice under Section 30.06.

That's it. Churches, hospitals, etc have to post 30.06 signs to block CHL holders. If the sign isn't posted or someone in a position of authority doesn't tell you that you aren't allowed, you haven't been given effective notice, and carry is not prohibited.

That's correct. (b)(6) is the churches
Sec. 46.035. UNLAWFUL CARRYING OF HANDGUN BY LICENSE HOLDER.

(b) A license holder commits an offense if the license holder intentionally, knowingly, or recklessly carries a handgun under the authority of Subchapter H, Chapter 411, Government Code, regardless of whether the handgun is concealed, on or about the license holder's person:
(6) on the premises of a church, synagogue, or other established place of religious worship.
...
(i) Subsections (b)(4), (b)(5), (b)(6), and (c) do not apply if the actor was not given effective notice under Section 30.06.

FWIW.... about 25% of the preachers I know carry at church...including me, right into the pulpit. Do not go to sleep during the sermon...you never know! ;-)

I carry on stage during the worship segment. I'm pretty sure I'm not the only one.

Every Friday night service, cousin and I both effect our 2nd Amendment, Constitutional right. LE deputies on duty know and appreciate that fact.

One thing about some Churches is they have schools. Not talking Sunday school but real state approved school programs.

Trinty Lutheran and Salem Lutheran are two. They have schools and separate sanctuaries but ajoined by hallways etc.

I'll bet there are plenty of Church/School combos out there..... Curious to see any responses to this.

I would not like to be the test case for this :txflag:

My woman asked me if it was really necessary that I carry to church. Then a few weeks back, a fella was shot during a midday midweek service in Atlanta. Her question has been answered.

IIRC, a preacher in Fort Worth was beaten to death recently with a guitar.

Now if the preacher had been armed, a Glock would beat that Gibson.

My pastor is a gun guy, and he's fine with concealed carry. I noticed shortly after he became aware, that some members in the congregation were armed, the quality and brevity of his messages improved! :thumbs2:

show her the articles of New Life Church in Colorado....that'll answer her question. The churches in CO Springs are very well armed.

I hadn't thought about the fact that there is a school attached to the church. Although school is not in session at that time. I would love to get a solid answer from an instructor. My church has a separate building for the school, however the school does use the sanctuary and fellowship hall during the week, and the church uses the classrooms on Sundays.

I am a Pastor who has a school. Somewhere on here I had this question and Mr. Cotton answered it, but I cannot remember what he posted. I cannot find the thread either.

Maybe he will catch this one and answer it again.
