Please help me interpret my workplace policy

Please help me interpret my workplace policy

I'm pretty sure I'm okay to carry at work, but I want to run the wording of the company policy about weapons by you guys. Among the list of things that will get you immediately terminated is this:

"Possession of firearms, explosives, or any lethal weapon on company property, in accordance with state law"

The "in accordance with state law" part makes me think that it is okay since state law says I can legally carry. Oh, and the building is NOT 30.06 posted. Thanks in advance for your help.

I don't know. Adding that little part at the end makes the sentence nonsensical.
I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.

OR it could meen “in accordance with state law” we are telling you no gun.

Just my opinion here. :tiphat:
I would carry. Of course, concealed is concealed. If by the off chance you were discovered, I would tell them that I interpreted the statement as you have stated. Would they fire you on a "misunderstanding"?

Are you sure you didn't leave this word out?

Nope, I just reread the policy, which is printed out and is lying in front of me, and it is as I originally posted.
Thanks for your replies, folks. I think I will carry. I don't think they would can me if I got "discovered". Feel free to keep chiming in on this topic, however. My mind can be changed...

Toadstone, I do not see any misinterpretation on your part.
If I read that, to me it says "carry in accordance with state law"
You have a CHL, you are not carrying past a 30.06, 51% or other prohibited locations, so if I work where you work, I strap it on and carry away.

PC §30.06. TRESPASS BY HOLDER OF LICENSE TO CARRY
CONCEALED HANDGUN. (a) A license holder commits an offense if
the license holder:
(1) carries a handgun under the authority of Subchapter H, Chapter
411, Government Code, on property of another without effective
consent;

You are carrying under Chapter 411 Subchapter H

GC CH. 411. DEPARTMENT OF PUBLIC SAFETY OF THE STATE
OF TEXAS
Subch. H. LICENSE TO CARRY A CONCEALED HANDGUN
GC §411.203. RIGHTS OF EMPLOYERS. This subchapter does not
prevent or otherwise limit the right of a public or private employer to
prohibit persons who are licensed under this subchapter from carrying
a concealed handgun on the premises of the business.

Subchapter H does not apply to your employer, so 30.06 does not apply to your employer. So you are under 30.05

PC §30.05. CRIMINAL TRESPASS. (a) A person commits an offense
if the person enters or remains on or in property of another, including
residential land, agricultural land, a recreational vehicle park, a
building, or an aircraft or other vehicle, without effective consent and
the person:
(d) An offense under this section is:
(3) a Class A misdemeanor if:
(B) the person carries a deadly weapon during the commission
of the offense.

BUT

(e) It is a defense to prosecution under this section that the actor at
the time of the offense was:
(2) the person was carrying a concealed handgun and a license
issued under Subchapter H, Chapter 411, Government Code, to carry
a concealed handgun of the same category the person was carrying.

But at work you are not under chapter 411 subchapter H

The company do you work for (Not go give its name) But, it is a Major USA Corp, or State TX only or Less then 100 employes, Industry, Food, medical ?
And do you interface with the public...

Not that any of that matters, just Curious.. Most Major "Big" corp will put that in the Policy's, and then there will be "local Policy's" sometimes define by local and state?

And are you willing to risk your job, companies some times will let you go for "other reasons" ..I had a friend come back from a tour of Duty, and "Not allow to let you go" but was explained "for other reasons"

Its is something you have weigh in your life.. Me, I'd carry if I could.. IF anything it would give the NRA something to take on :tiphat:

In Texas, you can be fired for the way you part your hair and for several other, or no, reasons.

Toadstone:

Based on the information that you've provided, I would carry if I were you.

Make sure your concealment is good, do not discuss your carrying with anyone at work, and NEVER
ask Human Resources or your boss about the policy with regard to guns. They will only say NO.

You should be OK, Texas law-wise, but of course could get fired for carrying. Although they may tell you
it's because you parted your hair wrong. Or wore a blue shirt on a day containing "Y". :-)

2nd Saturdays: Rudy's BBQ, N. Dallas Pkwy, N.bound, N. of Main St., Frisco.

My concern would be, with a policy like this (and the desire of management to fire because of it), is being nice and driving coworkers to lunch and getting pulled over.
