30:05
I am just wondering if anyone has seen a business using a 30:05 sign? Our local movie theater has that posted. I carried many times before I saw the sign. That sign must be 12 feet above the ticket window. I don't know what made me look up that high but it caught my eye.
Never underestimate the power of stupid people in large groups!

Re: 30:05
I know, and I've posted in there, but there is no defined '30.05' sign in the statutes.
30.05 is General Criminal Trespass
As such, anything from 'No Trespassing' to a fence, to 8" Vertical Purple paint lines counts as Notice under 30.05.
(Seriously.. 8" Vertical Purple spray paint lines on Trees is a valid '30.05 sign'... Look it up)
So sure, someone can make a sign that says like 'in accordance with section 30.05 of blah blah', but that doesn't make it a '30.05 sign', as there is no such thing defined in the law, like there is for a 30.06 sign.
I guess I'm just getting mixed up in definitions.. Pretty much any sign is valid under 30.05, so to me, there is no specific '30.05 sign'... just 'signs that meet the definition of notice under section 30.05'
So if someone/someplace put up a sign that says 'In accordance with Texas Penal Code Section 30.05, it is illegal'... Just know that they pulled that verbiage out of their ear, and included a reference to make it sound official. It may be valid notice under section 30.05, but a Generic 'No Trespassing' Black and Orange sign is just as valid.

Re: 30:05
If someone is posting 30.05 (which is Criminal Trespass) in order to state no guns are allowed, it is a defense to prosecution if you have a CHL:
...
(f) It is a defense to prosecution under this section that:
(1) the basis on which entry on the property or land or
in the building was forbidden is that entry with a handgun was
forbidden; and
(2) the person was carrying a concealed handgun and a
license issued under Subchapter H, Chapter 411, Government Code, to
carry a concealed handgun of the same category the person was
carrying.

I just noticed your location. I just noticed that same sign in Greenville this past weekend and was doing a little searching to make sure I understood what it meant to me... Small world!Castex1 wrote:Our local movie theater has that posted...That sign must be 12 feet above the ticket window.
