disarmed by Friendswood PD

Post by lunchbox »

Thats right i was on my bike and got pulled over for out of date registration and was promptly disarmed without cause.

The officer acted as if this was the SOP :banghead:
"I have two guns. One for each of ya" Doc Holiday
"Out here, due process is a bullet."
"Why Johnny Ringo, you look like somebody just walked over your grave."
"forgiveness is between them and god its my job to arrange the meeting" man on fire

I got it back
my problem was that there was no cause for doing so the proceeded to question me on why i was carrying 3 guns witch frankly is none of his business.
i know both of these cops that showed up to the parking lot i pulled into they didn't recognize me but i have sold things to both of them. As i work at a police supply store

You are correct, however they may disarm only under certain conditions.

§ 411.207. AUTHORITY OF PEACE OFFICER TO DISARM. (a) A
peace officer who is acting in the lawful discharge of the officer's
official duties may disarm a license holder at any time the officer
reasonably believes it is necessary for the protection of the
license holder, officer, or another individual.
The peace officer
shall return the handgun to the license holder before discharging
the license holder from the scene if the officer determines that the
license holder is not a threat to the officer, license holder, or
another individual and if the license holder has not violated any
provision of this subchapter or committed any other violation that
results in the arrest of the license holder.

I have questions concerning the "reasonableness" of some of these incidents. Some of them smack of "policy".
Spartans ask not how many, but where!

Were they rude to you and treat you like a common criminal? I'm just curious. Can you file a complaint about it?

I'm really sorry this happened to you. Talk about a bad day. Is this something that happens often with the Friendswood PD? It might be something to look into.

So, you're saying the next time they buy anything made of fabric or leather, the dog might be permanently interested in it? :biggrinjester:

No and I'm surprised it happened this time. My wife and son have been stopped by FPD and never disarmed. Me too.
