A Case of Internet Chatting Ends with Aggravated Sexual Assault

A Lubbock grandfather is credited with holding a suspected online predator at gunpoint until police could arrive. Twenty-two year-old Brandon Ray Lewis is charged with aggravated sexual assault. The victim's grandfather says he found Lewis having sex with his 13-year-old granddaughter in front of their Northwest Lubbock home around 2:30 Monday morning.

Bad situation. How'd you like where the 911 operator asked if it was rape? The father had already said she was 13 years old, so the answer is automatically "yes"!

The exact same thing crossed my mind..... Of course, the father never states the age of the "young man", but my understanding of the law in Texas was that regardless of the age of the male, if the female is under 14 it is automatically statutory rape.

No matter, the father and grandfather both showed far more restraint than this citified Cajun would have.... In some parts of South Louisiana that "young man" would probably have become gator bait and never been heard from again.... :twisted:

I believe that statement to be inaccurate. There needs to be > than 2 years age difference between the parties before it can be statutory rape. Otherwise, why would (legally) a boy of 12 be the one in trouble if his girlfriend is 13? I know laws don't make sense a lot of the time, but that would just be even more stupid than most. So boy = 11, girl = 14 IS statutory with the girl being the perp.

IANAL and this post is not intended to condone or lessen the outrage at the situation here.

I went back and read the code on this.

Ref if you are interested is TX PC, Title 5, Section 22.011

I am not a lawyer, but by my reading of it, statutory rape occurs if the victim is under 17. Period. However, it is an afirmitive defense to prosecution if the perp was less than 3 years older than the victim AND the victim was not under 14 years of age.

So, on the point of boy vs. girl, the gender of the victim is irrelevant. (I was wrong on that point....)

On the other point, however, as I read it any sexual act with a person under 14 is considered statutory rape, regardless of the age of the other person. As for a situation where you have, for instance, a 11 year-old boy and 13 year-old girl, how do you determine who is the perp and who is the victim? I think a number of factors would have to come into play, including who instigated the act. I believe it would be very difficult to prosecute a case like that and claim that the 11 year old was the perp, but I can't say it is beyond conception.

Just talking about this makes me want to go wash my hands with Clorox....

I didn't really mean to make lite of the original issue...

I think its an appalling trend, and one I feel is not going to go away but get worse...Like everything else...

All we can do is plug the dike (horrible analogy, I know) and hope we raise our kids (my kids are still a gleam in my eye) with a better than average common sense level...

Questioning the grandfathers intent (even though he is "credited") is plain stupid, and should never seen the light of day...You know someone somewhere would be wrting this up in a different light...That kinda bugs me, slightly...

That rapist is extremely lucky to be breathing on his own if you ask me...

You know, I've been thinking about this story over the past few days. Maybe that my brother in law is an LPDO, but it's still on my mind.

The major underlying problem here is not that a 22 yrold was boinking a 13 yr old girl. Which, legal or not, sounds consensual.

The problem is that this girl is obviously reaching out (in this case - in the wrong places) for love and attention that she is lacking from the absence of true parents. Grandparents are great and all, but they're older, they've raised their kids. Grandparents that are left to raise their grandchildren are much more likely to be more lenient and vacant from the parental roles they may have filled 110% for their kids.

So, where are her real parents? Jail, after-life, rehab?

I just find it pretty sad that this girl could sneak out of the house at that hour and get busy in the back seat of the BF's car IN FRONT OF HER HOUSE!

what the heck is this world coming to? Someone else posted that this seems to be more prevalent lately. What is? Adults going after children or children having sex (with same age and older)?

If you're thinking that there is more and more adults going after children, I think that is a bit of a naive comment. There have always been adults that have an affinity for younger sexual partners. Rather there is a growing number of children that are seeking out sex and often with those that know how to manipulate this lack of love & attention for their sexual gain.

By the way, this 22-yr old punk is not a pedophile. He's a child molester. Two slightly different terms. Pedophiles seek out pre-pubescent children. This girl was 13. In terms of the maturity of sexual organs, she is not a child. Pedophile is more a term of nature, whereas child molester is a legal term. People have made rules that it is illegal to have sex with persons under 17-18. God made rules about what age the human body was ready for intercourse.

I IN NO WAY CONDONE THIS MANS OR ANY OTHER CHILD MOLESTERS ACTIONS.

I just want people to see the difference and make more educated distinctions. That of course is your choice, whether or not to make that distinction.

There are some religions and cultures where it is OK to have sex with a woman after she begins menstruating. Thanks, I stay right here in Texas where that isn't the case.

Just my $.02, eh, maybe that was $1.

Per the article: "Police say it was the victim's grandfather who noticed a suspicious vehicle outside, and saw the front door open. He walked out, found the two, then went back inside to grab the girl's father and a gun. He kept the suspect at gunpoint until police arrived."

You must have had pretty unadventurous teen years. I was an expert at sneaking out and back in, and I was one of the "good" kids.

Like all teens, I thought my parents were oblivious to the world between 10pm and 6am. Would you expect your parents to be looking out the window at 2am?

You must have had pretty unadventurous teen years. I was an expert at sneaking out and back in, and I was one of the "good" kids.

Like all teens, I thought my parents were oblivious to the world between 10pm and 6am. Would you expect your parents to be looking out the window at 2am?

My mother could sense the air pressure in the house change if a door or window was open. She'd meet me outside with her .38sp and I wouldn't be able to sit down for a week. THAT was parenting. By the time I was 16-17 my parents didn't have to worry about me sneaking out. All I had to do was ask, they knew I might go out and have a little fun, but they had raised me well enough to know I wouldn't do something stupid. I definitely didn't go out and screw some girl im my dad's truck in front of said girls house.[/i]
