Gun Shows and CHL

#1

Post by function12 »

Let's say you go to a gun show and they have the correct 30.06 sign. So, you take out you coneal pistol, clear the chamber, and remove the mag before you get up to the door. You put the mag and loose bullet in your pocket. Hand your pistol to the person at the door to have them put the super secure zip tie on it. They ask if you have any ammo and you say no. Have you broken any laws?

Good question. No way am I going to hand over $20 worth of ammo. It's not a crime to carry ammo. Besides, there's ammo all over the show so it's really silly for the door person to even ask.
I am scared of empty guns and keep mine loaded at all times. The family knows the guns are loaded and treats them with respect. Loaded guns cause few accidents; empty guns kill people every year. -Elmer Keith. 1961

This situation is similar to bringing booze or food into a venue where they have signs saying that it is forbidden. It is technically criminal trespass (PC §30.05), but the police will not arrest for it unless you refuse to leave when you are told to do so.

I don't think you are breaking any laws by saying no when you tell them you don't have your ammo. I agree with HV that it is silly. Dallas Market Hall asks you about the magazine if you don't have it in the gun. They sell magazines and ammo, so whats to stop you from taking what you bought and reloading.

As for the 30.06 though, I think if you put your handgun back in your holster and conceal, you are technically breaking the law. However, it is done at shows all the time. Main thing is they have checked your weapon and zip-tied it so unless you really are trying to break the rules, you are not going to have an ND.

I think if they hand me back the gun and let me enter, they just gave me effective consent.

I hate leaving my weapon in the truck but I knew the show would be posted yesterday so I took my clips with me. At least that way if a BG broke into my truck it would just be something to throw at someone, so to speak.

The shows in Fort Worth draw wind at high velocity so it is rare for me to go. On that rare occasion, I just don't carry.

Here's one for you...don't you think posting 30-06 at a gun show is hypocritical? If something happens, I plan to hide in a gun safe until ten minutes after I hear the last shot. Then, I'll come out a declare myself the winner! "rlol"

Problem Keith is that shows are held on city property a lot, especially in Houston so 30.06 isnt valid. No test case yet though. No the ammo would not be illegal, I dont think any laws address ammo or mags at all. I unload outside the door and pocket the ammo to get ziptied. I have had occasion to try holsters or something and pull my CCW out. I do reload and reholster in the bathroom of shows when i am leaving. I am not leaving a place like GRB and walking unprotected. That situation is an invitation to mugging. They know you have cash (a lot sometimes) going in and shiny guns coming out (or cash from a sale).
OT sorta, does any law address ammo or mags? For example can you legally carry a full mag in a school?

I know of no law that regulates carrying ammo.

If you are asked about it and lie, you might be violating 30.05. IANAL, and I am not aware of any case law on this.

If you are asked by an LEO and lie, you might be leaving yourself open to an obstruction charge.

For my own part, I would not lie. Too much self respect to lower myself that way. I'd rather look someone in the face and tell them the truth, whether they want to hear it or not. (Or if I think it is none of their business, I'll tell them that too. But if I am entering their property, it is their business, IMO. So they will get the truth.)

If the place was posted, I would leave my gun and mags in my truck.

I've visited the GRB area a few times. Once to attend the NRA Annual Meeting. It did not seem to me to be a place where there was a big risk of getting mugged. Of course, I was parked in the hotel parking deck that's more or less across the street, so I didn't have far to walk.

I asked an officer about this at the facility where I took my class, and he said there wasn't one, and said they didn't even have to be concealed.
Of course, what unwanted attention that might bring is another story...

To answer the OP, if your firearm is unloaded, and visible, then you aren't breaking 30.06.
Since there is no law about ammo, answer whatever you want.
You aren't under oath when an officer asks you, so lying is illegal.
He won't take kindly to it if he finds out later, but he never should, right???

I was thinking this same thing as I was walking into the gun Show in Fort Worth last Saturday. Kinda crazy if you ask me. OT: I didnt see any "great" deals. everything for sale could be purchased elsewhere for less money. IE. Folding stock for the 10-22 for 90.00 Bucks???I can get it all day long for less than 75.00 online. Best price I saw on an AR-15 lower was 124.00 for a stripped one. Gun shows are cool to walk around and fondle all of the armament but I think I will buy elsewhere.

Then either that part of Houston is much improved from when I was there more frequently (a decade or so ago), or you have been fortunate.
Remember, in a life-or-death situation, when seconds count, the police are only minutes away.

If the last time you were at the George R. Brown Convention Center was ten years ago, you would not recognize the place new. I was there last week. I was outdoors for several hours, and I think I was in sight of a bicycle or mounted police officer the entire time.

That area used to be thick with homeless people. I saw only a few, and they kept moving.
