Pleasure Pier Galveston

I was there with family this past weekend, 5-21-16, and decided to eat at Bubba Gump's but we did not, nor did we intend to, enter the "amusement park" section. We didn't see any other way to enter BG's besides the ramp, so up we went. The large 30.06 sign is still posted on the left side as you go up the ramp, about 40ish ft. from the street. I was confused because I knew that a year-round amusement park was statutorily off-limits and didn't need a sign. (After reading this thread I now understand that PP may or may not be considered an official amusement park. I'll let the experts debate that.) Anyway, I thought maybe the sign was for the restaurant. However, upon entering Bubba Gump's there was the standard "unlicensed possession" sign right inside the door, which in my mind trumped the 30.06 sign on the ramp.

Which brings me to my question: If the 30.06 is indeed intended to apply to the amusement park portion and not the restaurant, and assuming it is in fact legal (whether it is or isn't, IDK), wouldn't it have made more sense to put it at the top of the ramp, at the actual entrance where you have to pay to ride the rides? I'd hate for someone to see that sign on their way to BG's and disarm unnecessarily because they thought it applied to the restaurant too.

Probably have it that way so that you dont have to walk ALL THE WAY up there to see the 30.06. That is a long walk having to do it twice before you even get in! When i go there i do not ride the rides, it was before i got my LTC. Now that i have my LTC i am. Ot sure how i feel about pleople riding rides while carrying! BUT, i would like to carry because i know that trouble likes being "around" those types of places

I just wanted to point out that the unlicensed possession sign is irrelevant to the 30.06 sign and does not trump it. The unlicensed possession sign is required by law if they sell alcoholic beverages. It is a reminder from the state to all of the crooks that if you are already breaking the law as a misdemeanor by carrying a pistol without a permit, it becomes a felony if you enter the area covered by the license. Consider it the state's sign and not the owner's. It does not reflect any desire on the part of the owner to allow or ban guns.

The 30.06 sign is the owner saying that he doesn't care what the state allows, you cannot bring a concealed pistol in his premises when you have a license. You might consider it the owner's way of saying he does not want his customers to have passed a background check. So, in reality, the 30.06 sign trumps the "permission" granted by the unlicensed possession sign.

Is Bubba Gump's leasing the premises from the City of Galveston, or is it outside the property of the Pleasure Pier?

The amusement park clause of PC 46.035(f)(1) has these two odd conditions:

"Amusement park" means a ... facility or park where amusement rides are available for use by the public that is located in a county with a population of more than one million, encompasses at least 75 acres in surface area,...

Galveston County has fewer than 1 million population, and the Pleasure Pier is less than 75 acres (it's more like 3 acres). So even if this section were still in effect, it would not apply to the Pleasure Pier or the Kemah Boardwalk.

It was actually tailored to Six Flags in Houston, which at the time was the only place that met these conditions.

Nothing in Galveston that a visitor would go to has a valid 30.06 sign, only some credit unions.

Actually, if you go back and read the transcripts, it was a rep from San Antonio who tailored it to cover Sea World. Apparently they were afraid that you would pop a cap in Shamu and mount him on your wall....

I'm pretty sure the whole pier is property of the city of Galveston.

Let me preface with IANAL... This really needs to go through the proper channels - complain, report, and see what we hear back.

Search for 2501 Seawall Blvd, can someone confirm my thoughts that the pier is city property?

It says right there on the web site that no unlicensed so to me i'll just go as normal with my shirt over it and not worry about it .

Using the Street View feature of Google Maps you can see the 30.06 sign mounted on the left as you go up the ramp to the pier. The date of the image is April, 2015. Here is a link to the Street View that shows the 30.06 sign at the Pleasure Pier Galveston:

I was there this last Sunday, they have a valid 30.06 sign to the left on the wall when entering the boardwalk....way before the ticketing section. There is no 30.07 sign.

OC carry and carry on , i really would like to know for sure if anyone has had a problem there with OC because i will be there with the family week after next . I guess i will just have to test it if no one else has .

Worst case. They ask you to leave. They don't have authority to do so, so you have a cause of action. More likely, they ask you to put your weapon in your car. Either way, you have something else to add to your AG complaint.

I'm ignoring the unlikely best / worst case (depending on how you look at it) where you are arrested, and have a potential civil action for some serious money.

The sign is not valid because the pier is owned by the city. Conceal and carry on, or open carry if you want too.
