At the end of the day, a citizen was able to stop criminals from stealing his property because he was armed; At least three crooks are out there second-guessing whether their next victim will be likewise armed and alert.

Turned out pretty good in my book.

A licensed concealed handgun carrier fired several shots in the parking lot of a downtown hotel Sunday morning, when he came outside as a woman was stealing his truck, authorities said.

The man, whose name was not immediately released,told police he heard the sound of his red Ford F350 pickup's ignition starting around 10:30 a.m. and.....

Not sayin that he's fibbing, it just seems odd. He "heard" his truck being started in the parking lot...... He either had to be in the lobby, or in a crappy hotel, or his truck is really loud when it starts up. I know the hotels downtown and the nicer ones wouldn't let you hear something like that unless it was really really loud. And there's really only 2 kinds of hotels downtown, nice ones and crappy ones.

I'm just sayin it sounds kinda hinky. I am glad he prevented his truck from getting ripped.

I don't think so. It occurred at 10:30 a.m., and was just a theft. Your only justification woul dhave been that she was in possession of property and it could not reasonable be recovered any other way. Since she took off running when she saw the gun, the "recovery" occurred without deadly force, so it was not justified that way.

I'm a bit confused about this statement. Are you saying that if he had shot while she was running away from his truck he was not justified? I understand and agree with this. Or, are you saying that he was not justified in shooting when they were coming at him in their own truck because his truck was not in jeopardy any longer?

Thoughts on side issues...

Based purely on what I read above, it sounds perfectly justified to me.

The white pickup was being aimed straight for him, trying to run him down.

I wonder how he hit the passenger window if the truck was coming right at him?

Easy; You dodge left while still shooting as the truck is passing by you, or, the truck veers to the left while you are shooting and exposes the passenger side to you.

Just an observation -- it doesn't say that the bullet came from the left -- it could have come from the right, say thru an open driver's window, miss the driver, and out the closed pax window from the inside...strange things happen in gunfights. Making the wrong assumption can give one the wrong perspective on what happened in a gunfight.

If you read farther down, it was a Motel 6, so I would guess rooms open directly on the parking lot, and presumably his truck was parked close to his room, perhaps as close as 8 or 10 feet if directly in front of the door. If you own a truck, especially a loud one, it would pay to be suspicious if you heard a truck start up outside your door.

I would be hesitant to shoot just to recover my truck, as much as I like it. In a situation like this, where I can sound the alarm early, I would guess it would be much easier for the police to recover it, since it is big and bulky and easy to see. If someone was driving at me, getting out of the way would be first priority, but since the driver initiated deadly force, I would not be shy about blasting him or her in order to make sure that he or she didn't get a second chance if that looked likely.

I missed that part. That's what I get for skimming thru the read. But when I think of hotels downtown I don't think of the ones right off the highway. It makes perfect sense for him to have heard it being that "stripmall" type hotel. I now where that hotel is, its right down the street from Santa Rosa off durango and I10. So Being man enough to admit when I'm wrong, I retract my earlier observation.

An F-350 sounds like a tank starting up. And to another posters comment, I have seen a gazillion little tiny ladies driving gigantic trucks. I won't go into the Freudian aspects of that.

IMO, that's a bit of a broad blanketed statement.
I don't know what a tank sounds like when it starts but growing up in rural areas I have owned(or family owned) and driven several f250s and f350s and generally been around all sorts of heavy duty trucks. They don't all crank like a tractor trailer. It depends on the truck and whats been done to it, and whether its a gas or a diesel. But I agree about women driving larger pickup's. I used to deliver packages to a real estate office full of tiny 4 foot plus ladies that almost all drove big superduty Fords with the FX4 package. Some were duallies, but all were big heavty duty 4x4 rigs that basically served the purpose of grocery getting. A sad waste of resources in IMO.

I often wonder about how quickly I can confirm that it is my vehicle being violated. There are literally thousands of blue Dodge vans that look exactly like mine in Austin; and I have no bumper stickers. I once got into an Intrepid that I thought was my father-in-law's in a Target parking lot in Oklahoma City. I dug around the front seat and back seat looking for my coat until I noticed the exact same maroon '94 Intrepid parked next to it.

I'm guessing that it's probably suspicious looking like the appearnace Slim Jims, tools, broken glass, jittery activity, and of course the perp freaking if I said "Hello." Still if I saw someone calmly get into my van and drive off It would be too late by the time I was totally sure that it was my van being stolen.

The FBI thinks so. Killing of a suspect during the commission of a felony is justifiable homicide, according to the agency. Your local DA may not agree with that, but the FBI is right. It's one of those five per cent things Obama says you know in your heart.
