Well, we don't want to get rid of the law, just lower the penalty to the same as not having your driver's license.

As for the out of state visitors, the policy would be the same as it is now. If I cannot verify he can legally carry, he is unlawfully carrying and gets arrested. the visitors should be well aware of this if they have any sense at all (and since they are CHL's, I am presuming they do). But we could also get our federal representatives to put pressure on the FBI to alter NCIC/NLETS to give officers a way to check on out of state CHL's, just like we do DL's.

An out of state person can carry in their car without having a gun license at all, much less have it with them.

I like the idea to make unlicensed driving a misdemeanor like unlicensed carry. I also think driving with no license and no insurance should be a felony like unlicensed carry in convenience stores.

I agree to a point. If you have no license to drive, or are driving without insurance, then yes I agree that the penalty should be more. However, If you are driving and forgot your license/insurance at home, then its not that big a deal, and most judges would probably dismiss it if you show them to the court. Thats how it should be with our plastic as well. Someone posted a while back about getting a replacement for his lost CHL, and how long its taking. In the meantime even though he is licensed to carry, he cannot legally do so until the state sends him new plastic. No excuse for this. There should at the very least be some kind of temporary card to carry until the new plastic arrives. Common sense comes into play when the officer runs your Texas DL and it comes back with a CHL. If you have already notified the officer, as you should have, having the plastic or not should be treated the same as leaving your DL home.

Vermont has a great law concerning concealed carry. As long as you are legally entitled to do so, and the requirements are virtually the same as they are here by the way, you can carry there. No plastic required. Since the state does not issue a plastic license like we have, when someone visits Texas from Vt, they cant carry except in their vehicle. If someone from Texas visited Vt, and they met the requirements, they can carry with or without a Texas CHL.

I also like the way a failure to display a DL ticket is dismissed if you do show the DL to the judge. Not displaying your CHL should also have the same option.

Question was forgetting it not intentionally leaving it at home.
Never forgot my gun but did realize I did not have my liscense once.

I've been thinking about not renewing my license because its really not necessary anymore. I think the unlicensed people are getting a better deal. My .02cents

You know what the trick to all of this is???

Lets set it up...Because I had a discussion with a distinguished lawyer on this forum a couple of years ago about this...

Let say you are carrying a firearm IN your vehicle which is legal now, and that you do not fit into any of the restricting catagories as stated in the law that covers you in this instance...

A vague senario that presents a need to reasonably determine that you must defend yourself in the use of force or deadly force per the law in this state...Remember you are still in your vehicle...That "Castle Doctrine" thing is not in play at this time...(I know, poor choice of words, but I needed to get the point across...)

The law that protects your carrying of a firearm IN the vehicle becomes null and void, once you STEP OUT of that vehicle carrying (much less discharging that weapon) a firearm for ANY reason...

But in the long run, until someone tells me I do not need the "permission" slip to exersize my RKBA's, I will have my CHL and Utah (and soon to go away NH slip) plastic to cover me inside or outside my home, vehicle while out in public...

I am also a BIG fan of the state legislature passing an amendment (this next session) to eliminate the penalties for CHL'ers to notify law enforcement, for the very reasons non-CHL'ers carrying under this Motorist Protection Act of 2007, for the very same reasons they are not compelled to do so, as we are now...It only makes sense...Dispite my hypocracy to continue to do so everytime I am officially asked to do so by any Law Enforcement officer...

All I remember this doing to the general public (who were smart enough to take advantage of this provision in the law) was to basically encourage them to get their CHL's anyway, if they could...

Same thing has happened to me more than once...

I go somewhere, and forgot to grab my wallet...But guess what is faithfully hanging on my hip???

I get the feeling after years of discussing a great many issues with Law Enforcement about issues like this, that after a short investigation, most times it is not an appreciable damning thing if you forget, and have not tried to evade the issue by being up front with them...Like everyone knows...They'll find out anyway...One way or another...

Usually it takes alot for someone to loose their license to drive

Make the CHL flag another "classification" on the drivers license, this way I can hand the officer my drivers license and have it say CLASS: CM (CHL) and then in his computer the CHL number is tied to the drivers license in the database (as long as it isn't fed out thru public knowledge)

Usually to loose your license you have a pretty high misdemeanor or other law trouble that would almost guarantee a loss of the CHL as well.

Then when you renew your drivers license on your birthday, you renew your CHL as well.

It would take a HUGE paperwork trail and other logistical problems out of the beaurocrats hands, and would give LEO's INSTANT access to know if you have a CHL or not, if this was "the norm" for all states..kapow..they run your out of state license they know if you have a CHL or not...right? No drivers license when you get pulled over..you get to spend some time in the popo till the problem is figured out..even if you forget your wallet you KNOW your TDL# right?
